Property Registration (Sale Deed) in Jharkhand

Jharkhand state government scheme

Quick answer

Property registration in Jharkhand is done through Jhar Nibandhan at jharnibandhan.gov.in, the NGDRS portal of the Department of Revenue, Registration and Land Reforms. Citizens prepare the deed from the published templates, verify the plot against the Prohibited Property list, calculate the fee, buy an e-Stamp from a vendor or Pragya Kendra and attend the Sub-Registrar office for execution.

What is property registration in Jharkhand?

Property registration in Jharkhand is the compulsory registration of a sale deed with the Sub-Registrar under the Registration Act 1908, backed by payment of stamp duty and a registration fee. Section 17 of that Act makes registration compulsory for the sale of immovable property worth more than Rs 100, so every land, plot, house or flat sale in the state requires it. Until the deed is registered and endorsed, the buyer has no title, whatever has been paid or possessed.

The Department of Revenue, Registration and Land Reforms, Government of Jharkhand runs registration, and the state has moved onto NGDRS, the National Generic Document Registration System, with its citizen portal at jharnibandhan.gov.in. Jhar Nibandhan publishes deed guidelines and standard templates so you can prepare a document to the department's own format, verifies e-Stamp certificates, lists authorised stamp vendors and Pragya Kendras where e-Stamps can be bought, provides the Prohibited Property search, offers a fee calculator, and lets a logged-in citizen view their appointment. The department's older site at regd.jharkhand.gov.in still carries departmental online payment and payment verification.

Who can register a sale deed in Jharkhand, and who cannot?

Any adult of sound mind who lawfully owns the property may sell, and any person legally entitled to hold immovable property in India may buy. Both parties need original identity documents, and both must attend the Sub-Registrar office in person or through a registered Power of Attorney holder.

Jharkhand has stronger statutory restrictions than most states, and the following cannot apply without first satisfying them:

  • A non-tribal buyer of land held by a Scheduled Tribe raiyat cannot register the transfer. The Chhotanagpur Tenancy Act 1908 governs most of the state and the Santhal Parganas Tenancy Act 1949 governs the Santhal Pargana division, and both sharply restrict transfer of tribal land: in Santhal Pargana, sale of raiyati land outside narrow exceptions is barred altogether. A transfer made in breach is void, not merely irregular.
  • A buyer of a plot listed in the Prohibited Property search cannot register it, because the government has flagged the plot as government land, disputed or otherwise not transferable.
  • A seller whose name is not in the Register-II or khatiyan cannot register until the earlier inheritance or purchase is mutated.
  • A minor cannot execute a sale deed as seller; a guardian must act, with court permission where required.
  • Property under attachment, injunction or an unreleased bank mortgage cannot be transferred clear of the charge.
  • A foreign citizen who is not an NRI or OCI cannot buy immovable property in Jharkhand without Reserve Bank of India approval.

What does registering a sale deed cost in Jharkhand?

Jharkhand charges stamp duty and, separately, a registration fee. Both are computed on the consideration written into the deed or the government's notified minimum value for the plot, whichever is higher, so writing a lower price into the deed does not lower the duty, it only risks the deed being impounded for deficit duty and penalty.

Instead of working from a percentage someone quotes you, use the fee calculator on jharnibandhan.gov.in. It applies the department's current schedule and the notified value for the plot you describe, and it returns the stamp duty and the registration fee together. Print or screenshot the result and take it with you.

Stamp duty is paid by buying an e-Stamp certificate in the buyer's name. Jhar Nibandhan lists the authorised stamp vendors and the Pragya Kendras, Jharkhand's common service centres — where e-Stamps are sold, and it provides a Verify eStamp service so you can confirm the certificate is genuine before you present it. Verify it. Fake and reused e-Stamp certificates are a real problem, and the buyer, not the vendor, carries the loss when a deed is found under-stamped years later.

Using the portal is free. The templates, guidelines, prohibited-property search, e-Stamp verification and fee calculator all cost nothing. A Pragya Kendra may charge its notified service fee for helping you, and an advocate or deed writer may charge for drafting. No one is entitled to money for "getting the registry done", "arranging a date" or "managing the SRO". Those payments buy nothing the law recognises.

How to register a sale deed in Jharkhand (step by step)

  1. Check the Prohibited Property list. On jharnibandhan.gov.in, run the Prohibited Property search for the district, thana and plot number before paying any advance. If the plot appears, stop. It cannot be registered.
  2. Check the tenancy status and the land record. Pull the khatiyan, Register-II entry and current rent receipt through Jharbhoomi and confirm whether the land is CNT- or SPT-protected and whether the seller is the recorded raiyat.
  3. Calculate the cost. Use the fee calculator on Jhar Nibandhan for the stamp duty and the registration fee on the higher of the sale price and the notified minimum value.
  4. Draft the deed. Use the deed guidelines and standard templates on the portal, filling in khata, plot number, thana number, area, boundaries, consideration and mode of payment exactly as they appear in the land record.
  5. Buy and verify the e-Stamp. Purchase the e-Stamp certificate for the calculated duty from an authorised stamp vendor or Pragya Kendra listed on the portal, then confirm it through Verify eStamp. Pay the registration fee and keep the receipt.
  6. Fix and view the appointment. Log in, complete the document details and confirm your appointment with the Sub-Registrar office having jurisdiction over the plot through the View Appointment service.
  7. Attend and execute. The seller, the buyer and two witnesses attend on the appointed day with original Aadhaar, PAN, the deed on the e-Stamp, the fee receipt, the land record extract and the rent receipt. The office captures photographs and thumb impressions, the Sub-Registrar admits execution and returns the registered deed.
  8. Apply for dakhil-kharij. After registration, apply at the Circle Office or on Jharbhoomi so the Register-II entry moves into your name.

Is there an offline route in Jharkhand?

Yes for the paperwork, no for the appearance. Deed writers at the Sub-Registrar complex draft documents, stamp vendors sell e-Stamps over the counter, and Pragya Kendras handle online steps for citizens who cannot do them at home, at the notified service charge. Land record extracts and rent receipts come from the Circle Office. But execution is always physical: the parties and witnesses must appear before the registering officer, be identified and have their biometrics captured. Note also that Jhar Nibandhan has carried notices restricting citizen services to particular hours, so finish the online steps in advance rather than on the morning of the appointment.

How do I check status and confirm the transfer?

The Sub-Registrar returns the registered deed with the deed number, book and year endorsed on it. Your Jhar Nibandhan login shows the document and appointment status while the process is running. Afterwards, track the dakhil-kharij application on the Jharbhoomi portal. The Circle Officer's mutation order and the first rent receipt in your name are what actually complete the transfer for revenue purposes. Keep the registered deed, the mutation order and the rent receipt together; banks and courts ask for that set, not for the deed alone.

Why do Jharkhand registrations fail?

  • The land is CNT- or SPT-protected tribal land and the buyer is not eligible, making the transfer void.
  • The plot appears in the Prohibited Property list.
  • The consideration is below the notified minimum value, so the deed is under-stamped.
  • The seller is not the recorded raiyat because an earlier succession was never mutated.
  • The e-Stamp certificate fails verification, or is in the wrong name or value.
  • The plot number, thana number or area in the deed does not match the khatiyan.
  • One of the four persons required at execution did not attend.

Where do I complain?

Take the first complaint to the Sub-Registrar and then to the District Sub-Registrar, and escalate to the Inspector General of Registration under the Department of Revenue, Registration and Land Reforms. Technical problems with the portal or e-Stamp verification go to the helpdesk email published on Jhar Nibandhan, helpdesk.ngdrs@nic.in. A refusal to register is appealable to the Registrar under the Registration Act 1908, and the Sub-Registrar must record the reason for refusal in writing, insist on that endorsement. For a transfer of tribal land that has already happened, the remedy runs through the Deputy Commissioner under the CNT or SPT Act, which can restore the land to the original raiyat.

Frequently asked questions

Which portal handles property registration in Jharkhand?

Jhar Nibandhan at jharnibandhan.gov.in is Jharkhand's NGDRS registration portal, run by the Department of Revenue, Registration and Land Reforms. It carries deed guidelines and templates, e-Stamp verification, a list of stamp vendors and Pragya Kendras, the Prohibited Property search, a fee calculator and appointment viewing.

What is the Prohibited Property search and why must I use it?

Prohibited Property search on Jhar Nibandhan lists plots the government has barred from registration — typically government land, land under dispute, or land protected by tenancy law. Check your plot before paying any money, because a plot on that list simply cannot be registered.

Can a non-tribal buy tribal land in Jharkhand?

No, not freely — land held by Scheduled Tribe raiyats is protected by the Chhotanagpur Tenancy Act 1908 and the Santhal Parganas Tenancy Act 1949, which restrict transfer to non-tribals and often to members of the same community and area. Registration of such a transfer without the permission those Acts require is void, and this is the single biggest cause of failed land purchases in Jharkhand.

Where do I buy the e-Stamp in Jharkhand?

Buy the e-Stamp certificate from an authorised stamp vendor or a Pragya Kendra — Jhar Nibandhan publishes the list of both — and then confirm it through the Verify eStamp service on the portal before you go to the Sub-Registrar.

How much stamp duty and registration fee will I pay?

Use the fee calculator on jharnibandhan.gov.in, which applies the current rate schedule and the notified minimum value for your plot, rather than a quoted percentage. Stamp duty is charged on the sale price or the government's minimum value, whichever is higher, and the registration fee is charged separately on the same value.

Do all four persons have to attend the Sub-Registrar office?

Yes, the seller, the buyer and two witnesses attend together, and the office captures photographs and thumb impressions of each before the deed is registered. A registered Power of Attorney holder can appear for a party who genuinely cannot attend.

What is dakhil-kharij and when do I apply?

Dakhil-kharij is mutation of the land record so the plot stands in your name at the Circle Office. Apply after the deed is registered, through the Jharbhoomi portal or at the Circle Office, because a registered deed alone does not change the Register-II entry.

Are Jhar Nibandhan services always available?

No — the portal has carried notices restricting citizen services to specific hours, so check jharnibandhan.gov.in for the current service window before you plan a session. Deed preparation and payment steps should be finished well before your appointment date.
