Legal Heir / Succession Certificate in Mizoram
Mizoram state government scheme
Legal Heir Certificate in Mizoram is issued offline by the Deputy Commissioner's office, not through DC Online at dconline.mizoram.gov.in, whose district service lists cover tax exemption, income, residential and Scheduled Tribe certificates but no heirship service. A succession certificate for bank deposits and securities comes only from the District and Sessions Judge under the Indian Succession Act 1925.
What is a legal heir certificate in Mizoram?
A legal heir certificate in Mizoram is a district administration document that records who the surviving heirs of a deceased person are, with each heir's age and relationship. Mizoram issues it through the office of the Deputy Commissioner of the district, on verification routed through the Sub-Divisional Officer and, crucially in Mizoram, the Village Council of the locality where the deceased lived.
Two structural features of Mizoram shape this process, and both differ from mainland practice.
First, Mizoram has no Tehsildar cadre. Where a family elsewhere in India goes to a tehsil office for heirship, a Mizoram family goes to the Deputy Commissioner's Facilitation Centre, the same counter that handles income, residential and Scheduled Tribe certificates.
Second, the Village Council is a genuine layer of verification, not a formality. The Village Council President's certificate underpins district administration certificates across Mizoram, and in a heirship enquiry it usually carries more practical weight than any document a family can produce, particularly for older heirs with no birth record.
The certificate is not available online. DC Online at dconline.mizoram.gov.in is the district administration's e-service platform for Mizoram, and the district service lists it supports: Aizawl publishes Tax Exemption Certificate, Income Certificate, Residential Certificate and Scheduled Tribe or Scheduled Caste Certificate, along with a grievance channel; do not carry a legal heir or succession certificate. Expect an in-person application.
The parallel route is the succession certificate, which is a court document under central law. Sections 370 to 390 of the Indian Succession Act 1925 empower the District Judge to certify who may collect debts due to the deceased and deal with securities in the deceased's name. In Mizoram that jurisdiction belongs to the District and Sessions Judge, and the petition is filed under Section 372.
Which certificate does your claim need?
Use the legal heir certificate from the Deputy Commissioner when the claim lies against a government or quasi-government office and is modest in size:
- Family pension, commuted pension and pension arrears of a deceased Mizoram government employee.
- General Provident Fund, gratuity and group insurance dues.
- Compassionate appointment of a dependent in a state department.
- Arrears of pay and leave encashment.
- Change of head of family on the ration card, and transfer of a gas connection or electricity meter.
- Release of small bank balances within the branch's internal ceiling for heirship declarations.
Use the succession certificate from the District and Sessions Judge when a third party holds money or securities and wants a court order before releasing them:
- Fixed deposits and savings balances above the bank's internal threshold.
- Shares, debentures and mutual fund units held without a nomination.
- Insurance proceeds where no nominee was registered.
- Debts owed to the deceased by any other person.
Neither certificate settles ownership of immovable property. Mizoram land is largely held under the state's own settlement system, including Land Settlement Certificates administered by the district administration, and transfer of a holding after death follows that process. A genuine dispute over title is a civil suit.
Who can and who cannot apply?
You can apply for a legal heir certificate in Mizoram if you are a surviving next of kin of a person who died while ordinarily resident in the state:
- The widow or widower of the deceased.
- Sons and daughters, including lawfully adopted children.
- The mother, and the father where the applicable personal law makes him an heir.
- Children of a predeceased son or daughter, taking their parent's share.
- The natural or court-appointed guardian of a minor heir.
You cannot apply in Mizoram where the deceased neither died in nor ordinarily resided in the state, because the Deputy Commissioner's authority is territorial. You are also not eligible where your interest is that of a creditor, employer, business partner or landlord rather than an heir, those claims go to a civil court. A Deputy Commissioner will further decline the file where a registered will has been produced, because a will replaces intestate succession and the executor's remedy is probate or letters of administration from the District Judge.
Mizoram applies no income limit, no caste condition and no minimum property value to a legal heir certificate. A Residential Certificate or Scheduled Tribe Certificate may be asked for to show that the deceased belonged to the district, not as a test of the applicant's own status.
What documents are required?
Mizoram Facilitation Centres assemble the heirship file from:
- Death certificate of the deceased from the registrar of the Village Council area, Municipal Council or hospital.
- Written application to the Deputy Commissioner, naming the deceased, the date and place of death, the last residence and all surviving heirs.
- Affidavit of heirship on stamp paper, sworn before a notary or Executive Magistrate, listing every heir and declaring that none has been omitted.
- Village Council certificate or recommendation confirming the family composition, the piece most often missing from a rejected Mizoram file.
- Photo identity proof of the applicant — Aadhaar, voter ID or PAN.
- Proof of relationship for each heir: birth certificates, school certificates, family ration card, or a marriage certificate for a spouse.
- Residential Certificate or Scheduled Tribe Certificate of the deceased, both district administration services.
- Service, pension or GPF papers of the deceased where the claim is pensionary.
- Passport-size photographs as the counter requires.
Carry originals for verification and a full photocopy set for the file.
How to apply for a legal heir certificate in Mizoram
- Register the death and collect the death certificate. Order four or five certified copies at the registrar's counter at once, because the bank, the insurer, the pension office and the Deputy Commissioner's file each retain one.
- Obtain the Village Council certificate. Approach the Village Council President of the locality where the deceased lived and get the family composition certified in writing. Doing this before you reach the Facilitation Centre saves an entire round trip.
- Prepare the affidavit of heirship. Draft it on stamp paper listing each surviving heir with name, age, relationship and address, and swear it before a notary or Executive Magistrate. Leaving an heir out is what most often causes a Mizoram heirship certificate to be cancelled later.
- Submit the application at the Facilitation Centre of the Deputy Commissioner's office with the death certificate, the affidavit, the Village Council certificate, the relationship proofs and your own photo identity.
- Pay only the counter fee and take a receipt. Mizoram publishes no rate for this service, so the receipt is your protection.
- Cooperate with the verification. The Sub-Divisional Officer or district staff check the family composition against the Village Council record and normally allow an objection window for any omitted heir.
- Collect the certificate from the Deputy Commissioner's office and ask for the extra attested copies you need in the same visit.
How to obtain a succession certificate in Mizoram
- File a petition under Section 372 of the Indian Succession Act 1925 before the District and Sessions Judge having jurisdiction over the deceased's ordinary residence or over the property.
- Attach the schedule of debts and securities claimed, account numbers with balances, fixed deposit receipts, share certificates and folio numbers, with the death certificate and relationship proofs.
- Pay the ad valorem court fee on the value of the debts and securities claimed, plus process and copying charges.
- Let the public notice period run, usually 45 days, during which an objector may come forward and convert the petition into contested litigation.
- Furnish security if the court directs it and collect the certified copy for the bank, company or depository.
How do you check the status of your application?
Mizoram provides no online tracking for a legal heir certificate, because the service is not on DC Online. Track it by the receipt or diary number issued at the Facilitation Centre and speak to the dealing assistant at the Deputy Commissioner's office. Mizoram's district administration publishes contact numbers for its offices; 0389-2326257 is the listed district administration contact used for Mizoram e-service queries, and every district portal carries a grievance channel of its own. For a court succession certificate, track the matter by case number in the District and Sessions Judge's registry.
Why are legal heir applications rejected in Mizoram?
- The Village Council certificate was missing, or it did not match the list of heirs in the affidavit.
- An heir was omitted from the affidavit and a rival claimant objected during verification.
- A registered will was produced, making probate or letters of administration the correct remedy.
- The application was filed in a district with no territorial connection to the deceased's last residence.
- Names or spellings differ between the death certificate, the ration card and the heirs' identity documents.
- The real dispute is over land held under a Land Settlement Certificate, which the heirship certificate cannot resolve.
- A civil suit or police case over the same estate is pending, so the file was held in abeyance.
What does it cost, and what about agents?
Mizoram issues the legal heir certificate at the government's counter fee only, plus the real cost of stamp paper and notarisation for the affidavit. The state does not publish a rate for it, so the receipt you take at the Facilitation Centre is the only record of what you paid, and nobody at the counter is entitled to anything beyond that figure.
Agents around district headquarters in Aizawl, Lunglei, Champhai, Serchhip, Kolasib, Mamit, Saiha and Lawngtlai offer to "arrange" heirship papers quickly for several thousand rupees. They cannot bypass the Village Council verification, they cannot shorten the objection window, and a certificate obtained on an incomplete affidavit falls apart the first time an omitted heir contests it. Get the Village Council certificate yourself, keep the affidavit truthful, and report any demand for extra money to the Deputy Commissioner's grievance channel.

Frequently asked questions
Can I apply for a legal heir certificate online in Mizoram?
No, Mizoram does not offer a legal heir certificate online. DC Online at dconline.mizoram.gov.in is the district administration's e-service platform, and the district service lists it supports — Aizawl district, for example, publishes Tax Exemption Certificate, Income Certificate, Residential Certificate and Scheduled Tribe or Scheduled Caste Certificate — do not include a heirship or succession certificate. The application is made in person at the Deputy Commissioner's Facilitation Centre.
Who issues a legal heir certificate in Mizoram?
The Deputy Commissioner of the district issues the legal heir certificate in Mizoram, on verification carried out through the Sub-Divisional Officer and the Village Council of the area where the deceased lived. Mizoram has no Tehsildar cadre of the mainland type; the Deputy Commissioner's office and the Village Council system between them perform the equivalent function.
What role does the Village Council play in Mizoram heirship?
The Village Council President's certificate is the standard local verification behind district administration certificates in Mizoram, and in a heirship matter it is usually the strongest evidence of who the surviving family members are. Mizoram families should obtain the Village Council recommendation before approaching the Deputy Commissioner's Facilitation Centre, because the file will be sent back for it otherwise.
What is the difference between a legal heir certificate and a succession certificate?
A legal heir certificate lists the surviving heirs and serves family pension, provident fund, gratuity, compassionate appointment and small claims, while a succession certificate is a court order under Sections 370 to 390 of the Indian Succession Act 1925 authorising the holder to collect debts and deal with securities of the deceased. Mizoram banks accept heirship for small balances but require the court certificate above their internal limit.
What does a legal heir certificate cost in Mizoram?
Mizoram does not publish a fee for the legal heir certificate, because it is not a listed DC Online service, so the amount payable is whatever the Deputy Commissioner's Facilitation Centre counter quotes plus the genuine cost of stamp paper and notarisation for the affidavit. Ask for a receipt for every payment.
Where do I get a succession certificate in Mizoram?
File a petition under Section 372 of the Indian Succession Act 1925 before the District and Sessions Judge having jurisdiction over the place where the deceased ordinarily resided. The court publishes a notice inviting objections, usually for 45 days, and grants the certificate on payment of ad valorem court fee on the value of the debts and securities claimed.
Does a legal heir certificate transfer land in Mizoram?
No, a legal heir certificate in Mizoram does not transfer land. Land in Mizoram is largely held under the state's own land settlement and Land Settlement Certificate system administered by the district administration, and transfer on death follows that process, with a contested title claim going to the civil court.
Does a Mizoram legal heir certificate expire?
A legal heir certificate in Mizoram carries no expiry date, because it records fixed facts about who survived the deceased. Banks and pension offices nevertheless often ask for a copy issued in the previous six months, and the Deputy Commissioner's office reissues an attested copy from the same file.
