OB&OCWWB Financial Assistance for Purchase of Safety Equipment (Odisha)
Odisha state government scheme
OB&OCWWB Safety Equipment Assistance reimburses up to Rs 1,000 to a registered Odisha construction worker for protective gear, and up to Rs 4,000 for working tools, under rule 278(2) of the BOCW Rules. The claim needs a purchase receipt from a registered shop and is filed in Form XLIV at the District Labour Office or at nirmanshramik.odisha.gov.in.
What is OB&OCWWB safety equipment purchase assistance?
OB&OCWWB Financial Assistance for Purchase of Safety Equipment is a reimbursement of up to Rs 1,000 paid by the Odisha Building and Other Construction Workers' Welfare Board to a registered construction worker who buys protective gear for the job. The Board was constituted on 3 January 2004 under Section 18 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 and works under the Labour & Employees State Insurance (ESI) Department, Government of Odisha, with the Labour Commissioner as its Member Secretary and chief executive officer.
The provision is rule 278(2) of the Orissa Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Rules, 2002. As substituted by Gazette Notification No. 933 of 30 May 2019, it reads that the Board may grant financial assistance up to Rs 4,000 for purchase of working tools and up to Rs 1,000 for purchase of safety equipment to the registered beneficiary, subject to production of purchase receipt of admissible items from a registered shop or company, and that such benefits may also be distributed to registered building and other construction workers in camp mode. The application is to be in Form XLIV.
The Rs 1,000 figure for safety equipment was first introduced by the Amendment Rules of 2014, notified in Odisha Gazette No. 449 of 1 March 2014, alongside the Rs 4,000 working-tools ceiling. Before that, rule 278(2) covered only working tools, at Rs 2,000 under the Amendment Rules of 2012. The 2014 text required the claimant to have completed at least one year of registration; the 2019 substitution drops that phrase from the safety-equipment and tools sub-rule while retaining a one-year condition for bicycles under rule 278(3). Where a district office insists on one completed year, the practical answer is to clear the anniversary before filing.
Funding comes from the Odisha Building and Other Construction Workers' Welfare Fund, which is built from the 1 per cent cess collected on construction works in the state under rule 263.
What counts as safety equipment and how much is paid?
The rules use the phrase "admissible items" and do not publish a closed list on the Board's portal, so the district office decides admissibility against the receipt. In construction practice the items that fit the description are helmets, safety shoes, gloves, safety belts and harnesses, goggles, dust masks, ear protection and reflective jackets.
The ceilings are firm:
- Up to Rs 1,000 for safety equipment.
- Up to Rs 4,000 for working tools, under the same sub-rule.
- Up to Rs 4,000 for a bicycle, under rule 278(3), for a beneficiary who has completed at least one year of registration.
- Rs 2,000 per month as a training stipend for skill development, for a maximum training period of six months, under rule 278(1).
All of these are reimbursements against receipts, and all are claimed in Form XLIV. Where the invoice value is less than the ceiling, the reimbursement is limited to the invoice value.
The camp-mode option matters in districts where workers cannot easily front the money. Rule 278(2) expressly permits distribution of these benefits in camps, and the Board's RTI proactive-disclosure handbook records that block-level camps are used for disbursement and that Collectors have been delegated powers to sanction assistance towards safety equipment and bicycles.
Who is eligible for safety equipment assistance in Odisha?
A worker can claim where all of these hold.
- The worker is a registered beneficiary of OB&OCWWB holding a Form XXVIII identity card, having registered between 18 and 60 years of age after working at least 90 days in building or other construction work in the preceding 12 months.
- The Rs 50 annual contribution under rule 267 is paid up to date for the current financial year.
- The worker has bought admissible safety equipment and holds a purchase receipt from a registered shop or company.
- The claim is made in Form XLIV within the period specified by the Board.
The following cannot apply or are not eligible.
- Construction workers who have never registered with OB&OCWWB. Registration with the District Labour Officer as Registering Officer is the precondition for every benefit of the Board.
- Beneficiaries whose membership has ceased under rule 267(3) after three continuous years of contribution default, unless the membership has been resumed on payment of arrears, permitted at most twice.
- A worker re-registered afresh after cessation, for a benefit already availed during the earlier registration.
- Spouses, children or other family members of a beneficiary in their own right; safety equipment assistance is personal to the registered worker.
- Anyone without a receipt from a registered seller, and anyone claiming twice for the same purchase.
- Workers outside building and other construction work, who are not covered by the BOCW Act at all.
How to apply for safety equipment assistance
- Confirm registration and contribution. Log in at nirmanshramik.odisha.gov.in through the Construction Worker Login, check that the Form XXVIII registration is active, and pay the Rs 50 annual contribution through the Pay Annual Contribution link if it is outstanding.
- Buy the equipment from a registered shop or company and obtain a printed invoice showing the seller's registration details, the items, the date and the amount. Keep the original safely β the claim stands or falls on it.
- Fill Form XLIV. The form is addressed to the Secretary of the Board and asks for the applicant's name, father's or husband's name, permanent and present address, registration number, the amount of annual contribution remitted with receipt number and date, age and date of birth, nature of job, particulars of the item purchased including description, make, invoice price and supplier's name and address, and the amount of grant applied for. Rule 285-A requires the form to be available in Odia and an Odia-filled form is valid for all purposes.
- Submit the claim. Upload the form with scans of the invoice, identity card, contribution receipt, bank passbook first page and Aadhaar through the Construction Worker Login, or submit the same set at the office of the District Labour Officer of your district.
- Sign the declaration honestly. Form XLIV carries a declaration that the applicant will refund the amount with interest if any information is found wrong.
- Track the application through the Application Tracking link on nirmanshramik.odisha.gov.in and watch the registered bank account for the credit.
If a welfare camp is held in your block, take the identity card and contribution receipt and collect the equipment in kind instead.
How do I check the status of my claim?
Application Tracking on the Board's portal shows the current stage against the reference number issued at submission. Payment is by direct transfer to the account recorded against the registration, so a sanction with no credit usually means the bank details on file are outdated. Update them through the Construction Worker Login and then take the matter to the District Labour Office, which processes and verifies the claim before sanction.
Why do safety equipment claims get rejected, and how do I fix it?
Lapsed membership. Rule 267 requires Rs 50 a year, remitted to the Registering Officer with a money receipt or bank receipt. Three continuous years of default ends the membership under rule 267(3). Clearing arrears and getting the membership resumed restores eligibility.
A receipt from an unregistered seller. The rule is explicit that the receipt must be from a registered shop or company for admissible items. A loose cash memo does not qualify.
Items outside the admissible range. General clothing, footwear that is not safety footwear, or household items will not be accepted as safety equipment.
Claiming more than the ceiling. Sanction is capped at Rs 1,000 for safety equipment regardless of the invoice value; a claim written for more is trimmed, not rejected, but it delays processing.
Duplicate or fraudulent bills. Rule 278(4), inserted in 2019, makes the beneficiary solely responsible for the authenticity of the bill and provides that on detection of fraud through double receipt of assistance or fraudulent documents, the amount released is recovered under the Odisha Public Demands Recovery Act and the membership is ceased. Rule 266(4) allows parallel action against facilitators and agencies involved in fake registrations, including blacklisting.
What are the key dates and where do I complain?
No annual last date is published for safety equipment assistance, so claims are accepted through the year subject to the period the Board may specify for a particular round. The date that recurs is the Rs 50 annual contribution, which follows the financial year defined in rule 248(g) and may be remitted in advance at any time during the year.
For grievances, the first authority is the District Labour Officer, who is the Registering Officer and the processing office for the claim. Above that is the Labour Commissioner, Odisha, Member Secretary of the Board. Write to the Odisha Building & Other Construction Workers' Welfare Board, Office of the Labour Commissioner, Unit-3, Kharavel Nagar, Bhubaneswar; telephone 0674-3120552; email obocwwboard@yahoo.com. The administrative department is Labour & ESI, Government of Odisha, at labour.odisha.gov.in.

Frequently asked questions
How much does OB&OCWWB pay for safety equipment?
OB&OCWWB grants financial assistance of up to Rs 1,000 for the purchase of safety equipment by a registered beneficiary, under rule 278(2) of the Odisha BOCW Rules as substituted by Gazette Notification No. 933 of 30 May 2019. The same sub-rule allows up to Rs 4,000 for working tools.
Is the money paid before or after I buy the equipment?
After. The assistance is a reimbursement, and the rule requires production of a purchase receipt for admissible items from a registered shop or company before the amount is sanctioned.
Who cannot claim safety equipment assistance?
Construction workers who are not registered with OB&OCWWB cannot apply, and a beneficiary whose membership has ceased for defaulting on the Rs 50 annual contribution for three continuous years is not eligible until the membership is resumed. Family members cannot claim in their own right.
Can safety gear be given without an individual claim?
Yes. Rule 278(2) as amended in 2019 states that such benefits may also be distributed to registered building and other construction workers in camp mode, so district camps can hand out equipment in kind.
What happens if the bill is found to be false?
Rule 278(4) makes the beneficiary solely responsible for the authenticity of the bill. On detection of a double claim or a fraudulent bill, the amount released is recovered under the Odisha Public Demands Recovery Act and the beneficiary's membership is ceased.
Does the employer not have to provide safety gear anyway?
Yes, the Building and Other Construction Workers Act, 1996 places safety, health and welfare duties on the employer. The Board's Rs 1,000 assistance is an additional support for a self-employed or independently working beneficiary, not a substitute for the employer's statutory obligation.
Which form is used to claim?
Form XLIV, prescribed under rule 278(2) and 278(3), titled Application for Grant for the Purchase of Working Tools. The same form covers safety equipment and bicycles, and is available in Odia.
