Legal Heir / Succession Certificate in Puducherry (Legal Heirship Certificate)

Puducherry state government scheme
Puducherry issues a Legal Heirship Certificate through the Department of Revenue and Disaster Management, using a bilingual English-Tamil application form published on revenue.py.gov.in. Applications go to the Taluk office or through the e-District Puducherry portal at edistrict.py.gov.in, whose toll free number is 1800 425 2260. Larger bank and share claims need a court succession certificate instead.
Legal Heir / Succession Certificate in Puducherry runs on two separate tracks, and families routinely lose months by starting on the wrong one. The Union Territory's Department of Revenue and Disaster Management issues an administrative Legal Heirship Certificate through the Taluk offices, and that is what a pension branch, an employer or a provident fund office normally wants. A succession certificate. The document a bank or a share registrar demands for a substantial financial claim; is a court order under the Indian Succession Act, 1925, and no revenue office can issue it.
Which department issues a Legal Heirship Certificate in Puducherry?
The Department of Revenue and Disaster Management, Government of Puducherry issues the Legal Heirship Certificate. The department is headed by the Special Secretary (Revenue)-cum-District Collector-cum-District Magistrate and operates from the New Revenue Complex, Vazhudavoor Road, near the Rajiv Gandhi statue, Puducherry 605 009.
Puducherry is unusual among Indian states and Union Territories because it is not geographically continuous. The UT is made up of four regions, Puducherry and Karaikal on the Tamil Nadu coast, Mahe on the Kerala coast and Yanam in Andhra Pradesh: each with its own revenue administration. That is why the e-District Puducherry portal offers its interface in English, Tamil, Telugu and Malayalam: a Yanam family and a Mahe family are dealing with the same UT department in different languages. Your application goes to the Taluk office having jurisdiction over the place where the deceased ordinarily resided, not to the region where you happen to live now.
The Revenue Department publishes the official Application Form for Legal Heirship Certificate as a downloadable PDF on its forms page at revenue.py.gov.in/forms.html, where it is listed first. The form is printed in English and Tamil side by side.
Who can and cannot apply for a Puducherry Legal Heirship Certificate?
You can apply if you are a legal heir of a person who died while ordinarily resident in the Union Territory of Puducherry: spouse, son, daughter, mother or father are the standard categories, and the form asks each heir's name, age, relationship to the deceased and marital status. The marital status column is not decoration; it is how the Taluk office records claims involving married daughters and widowed heirs.
You can apply as a guardian on behalf of a minor heir, with the minor named in the heirs table.
You can apply where the deceased had more than one wife, the Puducherry form asks directly whether the deceased had one wife or two, and requires the children of the first wife and the second wife to be listed separately with details enclosed. Few state forms confront this as openly.
You cannot apply if you are not an heir. A creditor, a business partner, a tenant or a family friend has no standing at the Taluk counter, whatever documents they hold.
You cannot use a Legal Heirship Certificate to force a bank to release a large deposit or a company to transfer shares. Those institutions are entitled to insist on a court succession certificate, and no revenue certificate overrides that entitlement.
You also cannot use this route where the deceased left a valid will. A will is proved by probate or letters of administration in the District Court, not by a Tahsildar's certificate. And families in Puducherry holding renonçant status: descendants of those who opted to be governed by French civil law before the Treaty of Cession; should take legal advice on which personal law governs the inheritance before filing anything, because the answer changes the list of heirs, not just the paperwork.
What documents does Puducherry ask for?
The Revenue Department's form itself is the checklist, and it is specific:
- The death certificate number, with the bracketed instruction that the original certificate is to be enclosed. Photocopies are a routine return.
- The family ration card number, which the Taluk office uses to cross-check the family you have declared.
- The full table of legal heirs; serial number, name, age, relationship and marital status.
- The purpose for which the certificate is required, with the note that necessary documents are to be enclosed. In practice this means the pension sanction letter, the employer's letter or the bank's written requirement.
- Where the applicant belongs to the Islamic religion, the details of the legal heirs as per Islamic rules, an instruction printed on the form itself.
- The applicant's relationship with the deceased, name of father or husband, sex, residential address and date of application.
The form closes with a warning worth taking seriously: the applicant shall be liable for prosecution for any misrepresentation or suppression of facts. Leaving an heir out of the table is exactly the kind of suppression that clause is written for, and the most commonly omitted heirs are the deceased's mother and married daughters.
How to apply for a Legal Heirship Certificate in Puducherry
- Register the death and collect the original death certificate from the registering authority, the municipality, commune panchayat or hospital-linked registrar where the death occurred. Nothing else moves until you hold this.
- Download the official form; "Application Form for Legal Heirship Certificate" from revenue.py.gov.in/forms.html; or pick up a copy at the Taluk office. It is free either way.
- Fill the heirs table completely. Every surviving heir, with age, relationship and marital status. Where the deceased had two wives, list the children of each separately. Where Islamic law applies, set out the heirs on that basis as the form permits.
- Assemble the enclosures: original death certificate, family ration card, proof of the purpose, and identity and residence proof for the applicant.
- Submit the set at the Taluk (Tahsildar) office having jurisdiction, or through the e-District Puducherry portal at edistrict.py.gov.in after registering, or at a Common Service Centre, which the e-District project designates as the village-level front end. Pay only the fee the counter enters on a receipt.
- Cooperate with the field enquiry. A Village Administrative Officer or revenue inspector verifies the family composition locally before the Tahsildar signs. Being reachable at the address on the form is the single biggest thing you control in the timeline.
- Collect the signed certificate and check every name and spelling against the death certificate before you leave the counter.
How to get a succession certificate from the court in Puducherry
- Confirm you need one. Ask the bank, company or registrar in writing what it requires. Many settle modest amounts on a nomination, an indemnity bond and a Legal Heirship Certificate, and litigation you did not need is expensive.
- File a petition under Part X of the Indian Succession Act, 1925 in the District Court having jurisdiction, the Principal District Court at Puducherry, or the court at Karaikal, Mahe or Yanam for those regions; listing every debt and security item by item and naming all heirs as parties.
- Pay the ad-valorem court fee, calculated on the value of the debts and securities. This scales with the estate, which is why a court certificate costs real money where a Taluk certificate does not.
- Wait out the citation period. The court publishes a general citation inviting objections, and a statutory waiting period runs before it can grant. Uncontested petitions commonly take several months.
- Collect the certificate and present it to the institution. It authorises collection only of the assets listed in it, anything you forgot to list is not covered.
How do I check the status of my application?
Track an e-District application through the Track Application page on edistrict.py.gov.in using the acknowledgement number issued when you submitted, and use the Quasi Application Track page for quasi-judicial matters. The portal's toll free number is 1800 425 2260. An over-the-counter application at the Taluk office is followed with the acknowledgement slip at the same counter, quoting the file number.
A District Court succession petition is tracked through the court's case information system with the case number your advocate gives you after filing, not through any Puducherry government portal.
Why do Puducherry legal heirship applications get rejected?
A photocopy of the death certificate submitted where the form asks for the original is the most avoidable failure. Second is an incomplete heirs table, an omitted mother, an omitted married daughter, or children of a second marriage left off. The Village Administrative Officer's field enquiry and the ration card cross-check are designed to catch precisely that, and the form's prosecution warning applies.
Third is a purpose stated without the supporting document the form asks to be enclosed. Fourth is name and spelling mismatch across the death certificate, ration card and application, common where names have been transliterated between Tamil, Telugu, Malayalam and English, which in a four-region UT happens more than most places.
Finally, a large share of Puducherry applicants simply need the wrong document: they want a bank to release a deposit, and only a court succession certificate will do it. Ask the institution first, in writing.
Where do I complain if the certificate is delayed?
Escalate first to the Tahsildar and then to the Deputy Collector (Revenue) of the region, quoting your acknowledgement number. The Department of Revenue and Disaster Management at the New Revenue Complex, Vazhudavoor Road, Puducherry 605 009 is the department headquarters, and the Special Secretary (Revenue)-cum-District Collector is the officer answerable for revenue service delivery.
For an application filed online, use the e-District toll free number 1800 425 2260 first, since the portal team can identify which desk the file is sitting on. A grievance that goes nowhere locally can be filed on the central CPGRAMS portal at pgportal.gov.in with the acknowledgement attached.
One last thing worth stating plainly. The Government of Puducherry publishes the Legal Heirship Certificate form free on its own Revenue Department website, accepts it at the Taluk counter, on e-District and at Common Service Centres, and charges only what appears on the receipt it hands you. No private agent is authorised to file, expedite or collect this certificate for a fee, and no amount of money shortens the Village Administrative Officer's field enquiry.

Frequently asked questions
What is the Puducherry legal heir document actually called?
Puducherry calls it a Legal Heirship Certificate, and the Department of Revenue and Disaster Management publishes an official bilingual English-Tamil "Application Form for Legal Heirship Certificate" for it on revenue.py.gov.in. In Tamil the same document is referred to as the varisurimai certificate.
Which office issues a Legal Heirship Certificate in Puducherry?
The Taluk (Tahsildar) office of the Department of Revenue and Disaster Management issues it, under the Special Secretary (Revenue)-cum-District Collector-cum-District Magistrate, whose office is at the New Revenue Complex, Vazhudavoor Road, Puducherry 605 009. The Karaikal, Mahe and Yanam regions are served by their own regional revenue offices.
What does a Puducherry Legal Heirship Certificate cost?
The Department of Revenue and Disaster Management does not publish a fee for the Legal Heirship Certificate on its own website, and its Citizen Charter was marked as under revision when this guide was checked. Ask for the fee at the Taluk counter or the e-District counter and insist on a receipt: whatever it is, it is a small statutory charge, not a negotiation.
How long does the Puducherry certificate take?
Puducherry does not publish a service standard in working days for the Legal Heirship Certificate on revenue.py.gov.in, so this guide does not quote one. Applications go through a Village Administrative Officer field enquiry before the Tahsildar signs, which is the stage that determines the real timeline.
What is the difference between a Legal Heirship Certificate and a succession certificate?
A Legal Heirship Certificate is an administrative document from the Puducherry Revenue Department naming who the heirs are, while a succession certificate is a court order under Part X of the Indian Succession Act, 1925 authorising you to collect the deceased's debts and securities. Banks, mutual funds and share registrars beyond their internal small-claim limits ask for the court certificate.
Does the Puducherry form treat Muslim families differently?
Yes, and it says so on the form itself. The Legal Heirship Certificate application carries a printed instruction that where the applicant belongs to the Islamic religion, the details of the legal heirs may be given as per Islamic rules. Puducherry has built that recognition into the form rather than leaving it to the counter.
Can I apply online in Puducherry?
Yes: the Directorate of Information Technology runs e-District Puducherry at edistrict.py.gov.in as a single window for citizen services, with registration, a Track Application page and a Quasi Application Track page, and a toll free number 1800 425 2260. Common Service Centres act as the village-level front end for the same platform.
Should I pay an agent to get this certificate?
No: the application form is a free download from the Government of Puducherry's own Revenue Department website, the Taluk counter and the e-District portal both accept it directly, and any charge is the government's listed fee paid against a receipt. An agent quoting thousands of rupees is selling you a queue you can stand in yourself.
