Marriage Registration Certificate in Bihar

Bihar state government scheme

Quick answer

Marriage registration in Bihar is applied for online at nibandhan.bihar.gov.in or before the Sub-Registrar designated as Marriage Registrar for the area where the husband or wife resides. Bihar's Registration wing issues the certificate on the same day for an already solemnised marriage, while a Special Marriage Act case takes a statutory 30-day public notice period, with the notice or application fee fixed at Rs 100 under Rule 10.

Benefit
An official Marriage Registration Certificate entered in the Bihar marriage register by the Sub-Registrar, accepted by banks, the passport office, insurers and foreign missions as legal proof of marriage
How to apply
Both — online on nibandhan.bihar.gov.in, or in person before the Sub-Registrar designated as Marriage Registrar in whose jurisdiction the husband or the wife resides

Bihar handles marriage registration through its Registration wing rather than through a separate services portal, and that single fact explains most of what confuses first-time applicants. The office you deal with is the Sub-Registrar's office, the same office that registers a sale deed, because the Sub-Registrar of the district is also designated as the Marriage Registrar. The Registration Department publishes its own note titled "Registration of Marriages: Process, documents and fee", and everything below follows what that note and the department's Rule 10 fee schedule actually say.

What is a marriage registration certificate in Bihar and who issues it?

A marriage registration certificate in Bihar is the state's permanent written record that a named man and a named woman were married on a stated date, entered in a marriage register maintained by the Sub-Registrar designated as Marriage Registrar. The Registration wing sits inside the Prohibition, Excise and Registration Department, Government of Bihar, and runs the nibandhan.bihar.gov.in portal on which marriage applications are filed.

The certificate is the document a bank asks for before adding a spouse to an account or a nominee record, the document the Regional Passport Office asks for when a married surname is claimed, the document an insurer asks for on a spousal claim, and the document every foreign mission asks for on a spouse or dependant visa file. Without it, a marriage that everyone in the family witnessed has no standing at a government counter.

Which two routes exist, and which one applies to you?

Bihar runs two genuinely different processes, and choosing the wrong one costs weeks.

Route one; registering a marriage that has already been solemnised. The wedding took place by religious or customary ceremony. You are asking the Marriage Registrar to record it. The Bihar Registration Department's process note is unambiguous about the timeline here: "The Certificate will be issued on the same day for the already solemnized marriage." No public notice period applies, because there is nothing to object to. The marriage exists. Hindu, Sikh, Buddhist and Jain marriages are registered under section 8 of the Hindu Marriage Act, 1955, and marriages already celebrated by other forms can be registered under section 15 of the Special Marriage Act, 1954, for which the department's schedule prints a separate Rs 200 fee described as "Registration of marriage celebrated in other terms under Sec-15".

Route two: solemnising a civil marriage under the Special Marriage Act, 1954. The marriage has not happened yet, or the couple wants a civil marriage independent of any religious ceremony. This is the route inter-faith couples take and what people commonly call court marriage. Here the department's note describes the sequence plainly: the authorities look for any objection from the public for 30 days, the process is then executed on the day of marriage by the assigned authority, and the applicant and witnesses sign the registry after the 30-day period to endorse the marriage. The 30 days are statutory. No officer in Bihar can shorten them, and any agent who promises to is selling something that does not exist.

Who can and who cannot apply for marriage registration in Bihar?

You can apply if the husband or the wife resides in the jurisdiction of the Sub-Registrar you approach. The department's note fixes jurisdiction by residence; "the respective registrar in whose jurisdiction the husband or wife resides"; not by the place where the wedding was held, which is a relief for the very common Bihar case of a wedding held at the bride's village and a couple living in another district. Both parties must have been of legal marriageable age at the time of the marriage, 21 years for the bridegroom and 18 years for the bride, and both must be of sound mind and capable of giving valid consent.

You cannot apply, or the Marriage Registrar will not register the entry, in these situations. A couple where either party was below the legal minimum age on the wedding date is not eligible, because the register cannot record a marriage the law did not permit. A person whose earlier marriage is still subsisting is not eligible, since registering a second marriage would record a bigamous one; where an earlier marriage ended, the divorce decree or the death certificate of the former spouse must be produced. Parties within the prohibited degrees of relationship, where no custom permits the marriage, are not eligible. A couple with no connection of residence to Bihar is not eligible before a Bihar Sub-Registrar and should approach the registering authority of the state where one of them resides. And in the Special Marriage Act route, a couple cannot complete registration while an objection filed during the 30-day notice period is still pending enquiry.

Which documents do you need for marriage registration in Bihar?

The Bihar Registration Department's published required-document list for the online application is short and specific: photograph of the bridegroom, Aadhaar of the bridegroom, photograph of the bride, and Aadhaar of the bride. Those four are the portal uploads.

The rest of the file is built at the counter. The application form must be duly signed by both husband and wife and submitted to the receiving authority together with the documents and the fee. Carry proof of date of birth for both parties, matriculation certificate, birth certificate or passport: because the Registrar has to be satisfied on age. Carry residence proof to establish that you have come to the correct Sub-Registrar. Bring two witnesses with their own Aadhaar or voter ID; the department's note states that the applicant and the witnesses will be asked to sign the registry to endorse the marriage.

For an already-solemnised marriage, carry evidence that the ceremony happened, the printed invitation card, photographs of the ceremony, or a certificate from the priest or person who solemnised it. Where either party was married before, carry the divorce decree or the death certificate of the former spouse.

What is the marriage registration fee in Bihar?

The Bihar Registration Department publishes a fee schedule under Rule 10 for proceedings under the Special Marriage Act, 1954:

  • Rs 100: notice of intended marriage, or application for registration of marriage, under Rule 10(i).
  • Rs 100, for recording an objection, under Rule 10(ii).
  • Rs 200, for every enquiry into an objection, under Rule 10(iii).
  • Rs 50, for every notice or summons to a witness for appearance, under Rule 10(iv).
  • Rs 200; solemnisation or registration fee, for solemnising or registering a marriage after 30 days, under Rule 10(v).
  • Rs 100; certified copy of an entry in the marriage notice book, or of an entry in the marriage certificate book, under Rule 10(vi).
  • Rs 100, certified copy of any entry of the marriage notice book other than a notice of any other proceeding, under Rule 10(vii).
  • Rs 200 — registration of a marriage celebrated in other terms under section 15, per Rule 10(viii).
  • Rs 600, for solemnising a marriage at a private place, plus Rs 25 for the Marriage Officer, under Rule 10(ix).
  • Rs 50; searching fee for a current-year entry, and Rs 100 for a previous-year entry, under Rule 10(x).

Every one of those amounts is a two- or three-figure government fee. Bihar charges nothing beyond the listed fee for the registration itself, and the whole online application on nibandhan.bihar.gov.in is free to fill. No agent, tout outside the Sub-Registrar's office or "marriage certificate consultant" has any authority to add a service premium on top of a Rs 100 statutory fee, and paying one buys nothing the portal and the counter do not already give you. If someone at or near a registration office demands more than the printed fee, ask for a receipt. The demand usually stops there.

How to apply for marriage registration in Bihar online

  1. Open nibandhan.bihar.gov.in and go to the marriage registration section. Create a new user account with your mobile number and email if you do not already have one, and verify the OTP.
  2. Choose the correct category before filling anything, registration of a marriage already solemnised, or a notice of intended marriage under the Special Marriage Act. The forms, the fee head and the timeline all differ from this point on.
  3. Fill the application form with the full names of both parties, both dates of birth, the exact date and place of the marriage (or of the intended marriage), the permanent and present addresses of both parties, and the particulars of the two witnesses. Select the Sub-Registrar office covering the residence of the husband or the wife.
  4. Upload the four required files; photograph of the bridegroom, Aadhaar of the bridegroom, photograph of the bride, Aadhaar of the bride, as clear scans.
  5. Pay the applicable fee under the Rule 10 schedule and save the payment receipt. Print the completed application form and have both husband and wife sign it.
  6. Submit the signed form with the supporting documents and the fee receipt to the receiving authority at the Sub-Registrar's office. The application is recorded in the registry after verification and you are given a receipt for the submitted application, keep it, it is your only tracking reference.
  7. Attend for endorsement. For an already-solemnised marriage the certificate is issued the same day. For a Special Marriage Act case, wait out the 30-day objection period, then attend with both witnesses to sign the registry, after which the certificate is issued.

How to apply offline before the Bihar Marriage Registrar

  1. Identify the Sub-Registrar's office covering the area where the husband or the wife resides, that officer is the designated Marriage Registrar for your case.
  2. Obtain and complete the marriage registration application form, and have it signed by both husband and wife.
  3. Submit the form at the receiving counter with the photographs, Aadhaar of both parties, age proof, residence proof, evidence of the ceremony where the marriage is already solemnised, and the prescribed fee. Collect the receipt for the submitted application.
  4. Attend with both witnesses on the date given. Sign the registry along with the witnesses, and collect the certificate, the same day for an already-solemnised marriage, or after the 30-day notice period in a Special Marriage Act case.

How do you check the status of a Bihar marriage registration application?

Sign in to the account you created on nibandhan.bihar.gov.in and open your application, or quote the receipt number from the acknowledgement the receiving authority gave you at the counter. The receipt for the submitted application is the reference the registry works from, and it is the number to quote in any query or escalation. If you applied through the counter route only, the receipt is your sole tracking document: photograph it the day you get it.

How long is a Bihar marriage certificate valid, and can you get another copy?

A Bihar marriage certificate has no expiry date and needs no renewal. The entry in the marriage register is permanent. What you will occasionally need is a fresh certified copy, for a visa file, a bank record or a court proceeding, and the published Rule 10 schedule charges Rs 100 for a certified copy of an entry in the marriage certificate book. A search of the register costs Rs 50 for a current-year entry and Rs 100 for a previous-year entry, so an old registration costs slightly more to retrieve than a recent one. Corrections to a name or a date go back to the same Sub-Registrar who made the original entry, supported by documentary proof of the correct particulars.

Why do Bihar marriage registration applications get held up?

Applications stall for a small set of repeated reasons. Approaching the wrong Sub-Registrar is the commonest, jurisdiction follows the residence of the husband or the wife, so a couple who marries in one district and lives in another must apply where they live. Submitting an application form signed by only one spouse is a straight return, because the department requires it duly signed by both. A date of birth typed into the form that does not match the matriculation certificate produced at verification is treated as a discrepancy, not a typo. Turning up for endorsement without both witnesses, or without their identity documents, means the registry cannot be signed that day. In a Special Marriage Act case, filing under the wrong head, applying to register a marriage that has not yet been solemnised, sends the file back to the start, and an objection recorded during the 30-day period suspends everything until the enquiry is decided. Where either party was married before, a missing divorce decree or death certificate of the former spouse stops the entry entirely.

Where do you complain if a Bihar marriage certificate is delayed?

Take the matter first to the Sub-Registrar who is handling your file, quoting the receipt number from your submitted application. If that does not move it, the District Sub-Registrar and then the Inspector General of Registration in the Registration wing of the Prohibition, Excise and Registration Department are the next authorities, and the department's contact details are published on state.bihar.gov.in/registration. Keep the receipt, the fee challan and the dates of every visit. An escalation with documented dates is treated very differently from a verbal complaint. Bihar's Right to Public Services framework also gives a formal appeal route where a notified service timeline is breached, and quoting your application receipt is what makes that appeal actionable.

Documents required

Photograph of the bridegroom
Listed first on the Bihar Registration Department's own "Registration of Marriages: Process, documents and fee" note as a required upload on the nibandhan portal.
Aadhaar of the bridegroom
Named explicitly in the department's required-document list. It is the identity and address proof the portal keys the application to.
Photograph of the bride
Second photograph in the department's list, uploaded alongside the bridegroom's.
Aadhaar of the bride
Named explicitly in the department's required-document list, on the same footing as the bridegroom's Aadhaar.
Application form signed by both husband and wife
The department's note states the application form must be duly signed by both husband and wife before it is submitted to the receiving authority with the documents and fees.
Proof of date of birth of both parties
Matriculation certificate, birth certificate or passport. The Marriage Registrar has to satisfy himself that the bridegroom had completed 21 years and the bride 18 years, so an age proof is asked for at verification even where the portal upload list is short.
Two witnesses with their own identity proof
The department's note states that the applicant and witnesses will be asked to sign the registry to endorse the marriage. Witnesses attend in person with Aadhaar or voter ID.
Proof of residence in the Sub-Registrar's jurisdiction
Registration is applied for with the registrar in whose jurisdiction the husband or the wife resides, so a residence proof establishes that the office chosen is the correct one.
Evidence that the marriage was solemnisedoptional
Marriage invitation card, ceremony photographs or a certificate from the priest or person who solemnised the marriage. Asked for in the already-solemnised (Hindu Marriage Act) route, not in a Special Marriage Act notice.
Divorce decree or death certificate of a former spouseoptional
Required only where either party was previously married, to show that no earlier marriage is subsisting.

Frequently asked questions

Where do I apply for marriage registration in Bihar?

Apply online at nibandhan.bihar.gov.in, or in person before the Sub-Registrar designated as Marriage Registrar in whose jurisdiction the husband or the wife resides. The Bihar Registration Department states both routes in its published note on the registration of marriages, and the jurisdiction rule follows residence, not the place of the wedding.

How long does a Bihar marriage certificate take?

The certificate is issued on the same day for a marriage that has already been solemnised, according to the Bihar Registration Department's own process note. A Special Marriage Act case is different — the authorities invite public objections for 30 days first, and only after that period do the applicant and witnesses sign the registry and the certificate follow.

What is the fee for marriage registration in Bihar?

Under Rule 10 of the Special Marriage Act fee schedule published by the Bihar Registration Department, a notice of intended marriage or an application for registration of marriage costs Rs 100, and the solemnisation or registration fee after the 30-day period is Rs 200. A certified copy from the marriage certificate book is Rs 100, and solemnising a marriage at a private place is Rs 600 plus Rs 25 for the Marriage Officer.

What is the difference between the Hindu Marriage Act and Special Marriage Act route in Bihar?

The Hindu Marriage Act route registers a wedding that has already happened by ceremony, and the Bihar Registration Department issues the certificate the same day. The Special Marriage Act route solemnises a civil marriage that has not yet taken place, requires a 30-day public notice for objections, and is the route inter-faith couples and court-marriage couples use.

How many witnesses are needed for marriage registration in Bihar?

Two witnesses attend with the couple and sign the marriage register. The Bihar Registration Department's process note states that the applicant and witnesses will be asked to sign on the registry to endorse their marriage, and witnesses must carry their own Aadhaar or voter ID.

Can an objection stop my Bihar marriage registration?

Yes, in the Special Marriage Act route an objection filed during the 30-day public notice period stops the process until the Marriage Officer enquires into it. The published fee schedule charges Rs 100 for recording an objection and Rs 200 for every enquiry into an objection, which shows the enquiry is a formal step, not a formality.

Does a Bihar marriage certificate expire?

No. A Bihar marriage certificate never expires and needs no renewal, because the entry sits permanently in the marriage register held by the Sub-Registrar. What you may need later is a certified copy, charged at Rs 100 per entry from the marriage certificate book under the published Rule 10 schedule.

Do both husband and wife have to appear before the Bihar Marriage Registrar?

Yes. The application form has to be duly signed by both husband and wife before submission, and both parties sign the registry with their witnesses at the endorsement stage. A registration cannot be completed by one spouse acting alone or by an agent.
