What is the Delhi BOCW Accidental Death Benefit?

Accidental Death Benefit is a scheme of the Delhi Building and Other Construction Workers Welfare Board (DBOCWWB), the statutory board under the Labour Department, Government of NCT of Delhi, constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. According to the board's welfare schemes page, if the death of a registered worker occurs due to an accident during employment, the nominees or dependants receive Rs 2,00,000 as a death benefit under Rule 278.

The board separately pays Rs 10,000 as funeral assistance under Rule 277 on the death of a registered member, whatever the cause. A family therefore claims two things, on the same visit, from the same office.

Construction is among the most dangerous occupations in India. Falls from height, scaffolding collapses, trench cave-ins, electrocution and vehicle strikes at project sites kill workers who usually leave behind no insurance and no employer settlement. The board's fund, built from the 1 per cent cess on construction cost in Delhi, is designed precisely for that moment, and Rs 2,00,000 is the largest single cash payout in the board's scheme list.

Key features

  • Rs 2,00,000 to nominees or dependants where death is accidental and occurs during employment.
  • Rs 10,000 funeral assistance under Rule 277.
  • Paid by Direct Benefit Transfer to the nominee's Aadhaar-seeded account.
  • Claimed on Form No. XXXVIII, the common death benefits form.
  • Natural death is covered separately at Rs 1,00,000 under the same rule.

Who is eligible for the accidental death benefit?

The claim can be made if:

  • The deceased was a registered member of the Delhi Building and Other Construction Workers Welfare Board, with membership live on the date of death.
  • The death was caused by an accident during employment.
  • You are the nominee recorded in the worker's board registration, or a dependant where no nominee was recorded.
  • You hold an active bank account seeded with Aadhaar to receive the DBT credit.

You cannot apply if:

  • The worker was never registered with the board. Registration was open only to workers aged 18 to 60 who had done at least 90 days of building or construction work in the preceding 12 months, certified by a contractor, employer or a registered construction trade union. There is no posthumous registration.
  • The death was from natural causes. That claim is valid but at the lower figure of Rs 1,00,000, on the same Form XXXVIII.
  • You are not a nominee or dependant. A friend, employer, landlord or contractor cannot claim the amount, though they may help the family file.
  • The worker's membership had lapsed and the missing annual subscriptions cannot be regularised.
  • The deceased was a contractor or employer rather than a wage-earning construction worker.

A point families get wrong: this is the board's own benefit and it does not replace compensation from the employer or the principal contractor under the Employees' Compensation Act, nor any police or insurance settlement. Claiming from the board does not bar those routes.

How to apply for the Delhi BOCW accidental death benefit

  1. Register the death and collect the certificate from the municipal authority, and obtain the post-mortem report and a copy of the FIR. These three documents together prove the death was accidental, which is what separates a Rs 2,00,000 claim from a Rs 1,00,000 one.
  2. Locate the deceased worker's registration card and note the registration number. If the card is lost, the board can trace the record from the name, father's name and registration year.
  3. Download Form No. XXXVIII; Death Benefits (Natural or Accident) under Rule 278 to from the Forms section of bocw.delhi.gov.in, or collect it at the board office. Also collect the funeral assistance claim under Rule 277.
  4. Fill the form in the nominee's name with the worker's registration number, date and circumstances of the accident, and the nominee's bank details, then attach all documents listed above.
  5. Submit the claim online through edistrict.delhigovt.nic.in under DBOCWWB services, or at the board office at A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054, and keep the acknowledgement.
  6. Follow up through the ward Shramik Mitra or on 011-23813773 / 011-23813845 until the sanction is issued and the DBT credit appears.

How to apply offline

  1. Ask the Shramik Mitra for your ward to visit. Under the Delhi Shramik Mitra Scheme launched on 9 November 2021, about 800 Shramik Mitras โ€” three to four per ward: help bereaved families assemble exactly these papers free of charge.
  2. Take Form No. XXXVIII, the death certificate, post-mortem report, FIR, the worker's registration card and the nominee's Aadhaar and passbook to the board office in Civil Lines.
  3. Submit at the counter, ask for a dated receipt, and file the funeral assistance claim in the same visit.

How much is paid and to whom?

Accidental Death Benefit is Rs 2,00,000, paid once, to the nominee recorded in the worker's registration. Where no nominee was named, the board pays the dependants, and that is where families run into delay: without a recorded nominee, a legal heir certificate or a succession document is usually required, and that alone can add months.

Rs 10,000 funeral assistance under Rule 277 is a separate, smaller and faster payment intended for immediate expenses.

Other board benefits stay open to the surviving family. Children continue to draw the education allowance of Rs 500 to Rs 10,000 a month by class and course under Rule 281 where they are already covered, and a spouse of a member who was already drawing pension can claim family pension of 50 per cent or Rs 1,500 a month, whichever is higher, under Rule 283.

How to check the claim status

  1. Sign in to edistrict.delhigovt.nic.in with the citizen account used to file and open Track your application.
  2. For an offline claim, quote the acknowledgement number to the board on 011-23813773 or 011-23813845.
  3. Once sanctioned, confirm the credit in the nominee's bank passbook. The board pays by DBT and does not issue cash or bearer cheques.

Common reasons accidental death claims fail

  • No nominee on record, so the board must first establish who the lawful dependants are.
  • Post-mortem not done, leaving no medical proof that the death was accidental. Without it the claim is usually settled at the natural death rate of Rs 1,00,000.
  • Membership lapsed before the date of death because the Rs 20 annual subscription was not paid.
  • Nominee's bank account not Aadhaar-seeded, so the DBT transfer bounces.
  • Name mismatch between the death certificate, the registration card and Aadhaar, very common where the worker used a short name at the site.
  • Accident not evidenced as during employment, where the FIR and the site report do not connect.
  • Wrong form. Form XXXVIII is the death benefit; Form XXXV is pension and Form XXXIX is disability pension.

If a claim is returned, take the missing document back to the same counter and have it recorded against the original application number rather than starting a fresh file.

Key dates and current position

Accidental Death Benefit is open all year with no window and no announced last date. File as soon as the death certificate and post-mortem report are available; delay makes it harder to obtain the police record and to prove that membership was live. The registration itself had to be done during the worker's lifetime, before age 60, which is why families of unregistered workers have no route here at all.

How to raise a grievance

  • Delhi Building and Other Construction Workers Welfare Board: 011-23813773 or 011-23813845.
  • Email: bocwhq.del@gmail.com
  • Office: A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054.
  • Shramik Mitra in your ward, for free help with the paperwork.
  • Labour Department, GNCTD, for escalation above the board.

No fee is payable to anyone for a death claim. The board's only official charges are Rs 5 for registration and Rs 20 as annual subscription, and no official will ask a grieving family for an OTP or a bank password.

Frequently asked questions

How much does the Delhi construction workers board pay on accidental death?

The Delhi Building and Other Construction Workers Welfare Board pays Rs 2,00,000 to the nominee or dependants if a registered worker dies in an accident during employment, under Rule 278. A separate funeral assistance of Rs 10,000 is payable under Rule 277.

Who receives the Rs 2,00,000 accidental death benefit?

The nominee recorded in the worker's board registration receives the amount, and where no nominee is on record it goes to the dependants. This is why naming a nominee at registration matters more than any other entry on the form.

Which form is used for the Delhi BOCW death benefit?

Form No. XXXVIII, titled Death Benefits (Natural or Accident) under Rule 278, covers both kinds of death claim. It is on the Forms page of bocw.delhi.gov.in.

What is the difference between accidental and natural death benefit?

Accidental death during employment carries Rs 2,00,000 while natural death carries Rs 1,00,000, both under Rule 278. The post-mortem report and the police record decide which one applies, so those documents are the heart of an accidental death claim.

Is the funeral assistance paid separately?

Yes. Funeral assistance of Rs 10,000 is provided under Rule 277 on the death of a registered member and is in addition to the Rs 2,00,000 accidental death benefit.

Can the widow also get a pension?

A surviving spouse can claim family pension under Rule 283 at 50 per cent of the pension the member was drawing or Rs 1,500 a month, whichever is higher. That applies where the member was already a pensioner.

What if the worker's registration had lapsed before the accident?

A lapsed registration is the most common ground for rejection, because the benefit attaches to live membership on the date of death. Ask the board whether the Rs 20 annual subscription can be regularised, and produce the last payment receipt you have.
