What is BOCW Funeral Assistance in Delhi?

Funeral Assistance is a benefit of the Delhi Building and Other Construction Workers Welfare Board, the statutory welfare board constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 and administered through the Labour Department, Government of NCT of Delhi. According to the Board's welfare schemes page, the benefit is provided under Rule 277 and amounts to Rs 10,000 in case of death of a member, payable "from the date of joining membership of the fund".

The purpose is narrow and immediate. When a construction worker dies, the family faces cremation or burial costs, and frequently the cost of transporting the body to a home village outside Delhi, within a day or two. Death benefit and pension take weeks to sanction. Funeral assistance is designed to be the first, smallest and fastest payment out of the same fund.

Delhi's Board funds all of this from the construction cess levied on building projects in the capital, which is why a worker pays only Rs 5 to register and Rs 20 a year to stay enrolled, while the Board's list of benefits stretches across pension, disability, maternity, marriage, education, tools, housing and skill development.

Key facts at a glance

  • Benefit: Rs 10,000, one time
  • Governing rule: Rule 277
  • Paid to: the nominee or dependants of the deceased registered worker
  • Cover begins: from the date of joining membership of the fund
  • Claim form: Form No. XLI
  • Filed with: the district labour office or the Board's head office at Vikas Bhavan-II, Civil Lines

Who is eligible for the Delhi BOCW funeral assistance?

A claim can be made if:

  • The deceased was a registered member of the Delhi Building and Other Construction Workers Welfare Board.
  • The membership was current, the Rs 20 annual subscription had been paid and the registration renewed.
  • The claimant is the nominee recorded with the Board, or a dependant of the deceased worker who can establish that relationship.
  • A death certificate issued by the competent municipal authority is available.

The underlying registration conditions are set by Section 12 of the parent Act and reproduced on the Board's Registration page: the worker must have completed 18 years but not 60 years of age, and must have been engaged in building or other construction work for not less than 90 days during the preceding 12 months, with the registration form verified by the contractor, the employer or a registered construction-sector trade union.

A claim is not eligible where:

  • The deceased was never registered with the Delhi BOCW Welfare Board. There is no funeral benefit for unregistered construction workers.
  • The membership had lapsed for want of the Rs 20 annual renewal.
  • The worker was registered with another state's construction workers welfare board rather than Delhi's.
  • The claimant cannot show nomination or dependency, a neighbour, contractor, or unrelated person cannot apply and be paid.
  • The deceased was a supervisory or managerial employee outside the definition of a building worker, and so was outside the Board's registration net in the first place.

What documents are required for the funeral assistance claim?

Document Mandatory Notes
Death certificate Yes Issued by MCD, NDMC or Delhi Cantonment Board
Form No. XLI Yes Prescribed funeral benefit form under Rule 277
Worker's registration card Yes Proof of live Board membership
Nomination record or dependency / legal heir proof Yes Establishes who is entitled to receive the money
Aadhaar of the claimant Yes Identity of the person being paid
Claimant's bank passbook Yes Payment is credited electronically
Post-mortem report or FIR No Relevant where accidental death benefit is also claimed

Prepare two sets. The same death certificate and registration card are needed again for the death benefit claim on Form XXXVIII, and for a family pension claim on Form XLV if the worker was already drawing pension.

How to apply for BOCW funeral assistance in Delhi

  1. Obtain the death certificate from the Municipal Corporation of Delhi, NDMC or the Delhi Cantonment Board, depending on where the death was registered. Nothing in the claim moves without it.
  2. Download Form No. XLI from the Forms page at bocw.delhi.gov.in, or collect a printed copy at the district labour office. Form XLI is specifically the funeral benefit form under Rule 277.
  3. Trace the worker's registration details; registration number, date of registration, and the last renewal receipt for the Rs 20 subscription. If the card is lost, the district office can retrieve the record from the number or the worker's name and Aadhaar.
  4. Fill the form with the deceased worker's particulars, the date and cause of death, the claimant's relationship to the worker, and the claimant's bank account with IFSC.
  5. Attach the supporting papers: death certificate, registration card copy, nomination or dependency proof, claimant's Aadhaar and bank passbook copy.
  6. File Form XXXVIII at the same time for the death benefit of Rs 1,00,000, or Rs 2,00,000 if the death was due to an accident during the course of employment. There is no reason to make two trips.
  7. Submit at the district labour office or at the Board's head office, A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054, and take a dated acknowledgement with a diary number.
  8. Follow up on the diary number on 011-23813773 or 011-23813845 until the sanction is passed and the Rs 10,000 is credited.

How does the funeral benefit sit alongside the death benefit?

The two are separate schemes with separate rules, separate forms and separate amounts:

Benefit Rule Amount Form
Funeral assistance 277 Rs 10,000 XLI
Normal death benefit 278 Rs 1,00,000 XXXVIII
Accidental death during employment 278 Rs 2,00,000 XXXVIII
Family pension (if worker was a pensioner) 283 50% of pension or Rs 1,500, whichever is higher XLV

A family whose earning member has died on a construction site in Delhi is therefore potentially entitled to Rs 2,10,000: Rs 2,00,000 accidental death benefit plus Rs 10,000 funeral assistance: provided the worker was registered and the accident occurred during the course of employment. Where death was from illness or natural causes, the combined figure is Rs 1,10,000.

For an accidental death, keep the FIR and the post-mortem report. Those two documents are what separate a Rs 1,00,000 sanction from a Rs 2,00,000 one.

How do you check the status of a funeral assistance claim?

The Board does not publish an online tracker for Rule 277 claims. Status is followed up in three practical ways:

  1. Quote the diary or receipt number at the district labour office where the claim was filed.
  2. Telephone the Board on 011-23813773 or 011-23813845, or email bocwhq.del@gmail.com with the worker's registration number.
  3. Watch the claimant's bank passbook β€” the sanctioned amount is credited directly, and the credit entry is the definitive confirmation.

Because funeral assistance is a small amount, it is often sanctioned in the same file movement as the death benefit. If the death benefit has been sanctioned and the Rs 10,000 has not, ask specifically whether Form XLI was taken on record, it is easy for a single form to be separated from a thick claim file.

Why do funeral assistance claims get rejected, and how are they fixed?

  • Membership lapsed. The Rs 20 subscription was not renewed for one or more years, so the deceased was not a live member. Prevention is the only cure, renew every year at any district office or online.
  • No nomination on record and no dependency proof. Fix: obtain a legal heir or dependency certificate from the SDM's office and file it with the claim.
  • Death certificate not produced. A hospital death summary is not a death certificate. Fix: register the death with the municipal body and obtain the certificate.
  • Name spelling mismatch between the registration card, Aadhaar and the death certificate. Fix: file an affidavit that the names refer to the same person.
  • Claimant's bank account inactive or in a third party's name. Fix: give a live account in the nominee's own name.
  • Registration record untraceable because the card was lost and the registration number is unknown. Fix: the district office can search by name, father's name and Aadhaar; carry every old receipt the family still holds.

Why does the Rs 20 annual renewal matter so much?

The Board states that every registered member must renew after every one year, that the renewal fee is Rs 20 per annum, that the eligibility for renewal is a minimum of 90 days of work as a construction worker, and that renewal can be done at any district office. Online renewal is available through the Delhi e-District portal at edistrict.delhigovt.nic.in, for which the Board publishes screenshot-by-screenshot guides.

Every death-linked benefit, funeral assistance, death benefit, family pension, is tested against membership status on the date of death. Families discover the lapse at the worst possible moment. A worker who keeps the Rs 20 renewal current is protecting a potential Rs 2,10,000 claim for his or her family, which is the single strongest argument for renewing on time.

Frequently asked questions

How much funeral assistance does the Delhi BOCW Board pay?

The Delhi BOCW Welfare Board pays Rs 10,000 as funeral assistance. The Board's welfare schemes page records it under Rule 277 as "Funeral Assistance in case of death of a member Rs. 10,000/-", available from the date the worker joined the fund.

Who receives the funeral assistance money?

The nominee or the dependants of the deceased registered worker receive the payment. Where a nomination was recorded at the time of registration the Board pays that person; where it was not, dependency or legal-heir proof has to be produced.

Which form is used for the funeral benefit claim?

Form No. XLI is the prescribed funeral benefit form under Rule 277. It is listed on the Board's Forms page next to Form XXXVIII, which is the form for natural and accidental death benefit, and both are usually filed together.

Can the funeral assistance and death benefit be claimed together?

Yes. Funeral assistance of Rs 10,000 under Rule 277 is separate from death benefit under Rule 278, which is Rs 1,00,000 for a normal death and Rs 2,00,000 where the death was due to an accident during the course of employment. Families routinely file Form XLI and Form XXXVIII together.

Is there a waiting period after registration before funeral assistance applies?

No waiting period is published. The Board's text says the funeral benefit is available "from the date of joining membership of the fund", the same wording used for maternity and death benefits, so cover starts with membership rather than after a qualifying number of years.

What happens if the worker's membership had lapsed?

A lapsed membership is the commonest reason a funeral claim fails, because the benefit is payable only in respect of a registered member. Renewal costs Rs 20 per year, so families should check the worker's renewal receipts before assuming the claim is hopeless.

Where is the funeral assistance claim submitted in Delhi?

Submit Form XLI with the death certificate at the district labour office or at the Board's headquarters, A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054. The Board's numbers are 011-23813773 and 011-23813845.

Does the Board charge anything for a funeral assistance claim?

No. Form XLI is a free download from bocw.delhi.gov.in and no fee is payable to file the claim. The only money a construction worker's family should ever pay the Board is the Rs 5 registration fee and the Rs 20 annual subscription.
