What is the Delhi BOCW Disability Pension?

Disability Pension is a scheme of the Delhi Building and Other Construction Workers Welfare Board (DBOCWWB), the statutory board under the Labour Department, Government of NCT of Delhi, set up under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. According to the board's welfare schemes page, the scheme pays Rs 3,000 per month to a registered construction worker who becomes permanently disabled because of paralysis, leprosy, tuberculosis or an accident, under Rule 275 of the Delhi BOCW Rules.

Alongside the monthly pension, the same rule provides a one-time ex-gratia of Rs 1,00,000 for permanent disability. The pension replaces lost daily wages month after month; the ex-gratia is a lump sum meant for the immediate costs of treatment, prosthetics, home modification or clearing debt taken during hospitalisation.

Disability Pension matters more in construction than in almost any other trade. A fall from scaffolding, a crush injury, an electrical burn or a spinal injury ends a career that ran entirely on physical capacity, and there is no employer pension or insurance behind a daily-wage mason. The board's cess-funded pension, the 1 per cent cess on construction cost in Delhi; is the substitute.

Key features

  • Rs 3,000 a month, paid by Direct Benefit Transfer.
  • Rs 1,00,000 one-time ex-gratia for permanent disability.
  • Covers paralysis, leprosy, tuberculosis and accident-caused permanent disability.
  • No age bar of 60, unlike the old age pension.
  • Claimed on Form No. XXXIX; the ex-gratia on Form No. XLVI.

Who is eligible for the Delhi construction workers disability pension?

You can claim disability pension if:

  • You are a registered member of the Delhi Building and Other Construction Workers Welfare Board with a valid card and a paid-up Rs 20 annual subscription.
  • You have become permanently disabled and hold a disability certificate from a competent government medical authority saying so.
  • The disability is caused by paralysis, leprosy, tuberculosis or an accident. The four causes the board names in Rule 275.
  • You hold an active bank account seeded with Aadhaar for DBT.

You are not eligible if:

  • You were never registered with the board. Registration requires you to be aged 18 to 60 with at least 90 days of building or construction work in the preceding 12 months, certified by a contractor, employer or a registered construction trade union. A worker injured before registering cannot register afterwards on the strength of the injury.
  • Your disability is temporary rather than permanent. A worker off work for a few months with a healing fracture is not covered by this pension, though hospitalisation of five days or more attracts the separate Rs 10,000 medical assistance under Rule 280.
  • Your membership has lapsed and the missing subscriptions have not been regularised.
  • You are a contractor or employer rather than a wage-earning construction worker.
  • You have no certificate from a recognised medical authority. A private doctor's letter on its own is generally not accepted in place of a government disability certificate.

Note that this scheme is not the same as the board's old age pension. Old age pension under Rule 273 begins at 60 and pays Rs 3,000 a month with a Rs 300 annual increase after five years of membership. Disability pension turns on medical condition, not on age.

How to apply for the Delhi BOCW disability pension

  1. Get the disability certified. Obtain a permanent disability certificate from a government hospital or the district medical board. The certificate must name the cause, paralysis, leprosy, tuberculosis or accident — because Rule 275 is written around those four causes.
  2. Check that your board membership is live. Confirm the registration card is valid and the Rs 20 annual subscription is paid. If it has lapsed, ask the board to regularise it before the claim is filed.
  3. Download Form No. XXXIX; Disability Pension under Rule 275 to from the Forms section of bocw.delhi.gov.in, and Form No. XLVI if you are also claiming the Rs 1,00,000 ex-gratia.
  4. Fill both forms with the registration number, trade, nature and date of disability, and bank account details, and attach the disability certificate, Aadhaar, bank passbook copy, medical records and photographs.
  5. Submit online through edistrict.delhigovt.nic.in under the DBOCWWB services, or in person at the board office, and keep the application number or the dated acknowledgement.
  6. Follow up on the medical scrutiny. Disability claims are usually referred for verification of the certificate, so respond quickly to any query rather than waiting for a fresh letter.

How to apply offline

  1. Visit A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054, the board's office, with the certificate and registration card.
  2. Ask the Shramik Mitra for your ward to fill the form for you. Under the Delhi Shramik Mitra Scheme, about 800 Shramik Mitras, three to four per ward, do this free. This route matters here, because a permanently disabled worker often cannot travel to Civil Lines.
  3. Submit Form XXXIX, and Form XLVI for the ex-gratia, at the counter and collect the receipt.

How much do you get, and when?

Disability Pension pays Rs 3,000 every month, credited by DBT to the worker's own Aadhaar-seeded account. The Rs 1,00,000 ex-gratia is a single payment made once the permanent disability is accepted. Together, a worker disabled at 40 receives the lump sum plus Rs 36,000 a year for the rest of a working life that would otherwise have earned nothing.

The board's other benefits remain open in parallel. A disabled member's children still draw the education allowance of Rs 500 to Rs 10,000 a month by class and course under Rule 281, and the family may still claim marriage assistance of Rs 51,000 for a daughter or Rs 35,000 for a son after three years of continuous membership.

How to check your claim status

  1. Log in to edistrict.delhigovt.nic.in with the citizen account used to file, and open Track your application.
  2. Quote the acknowledgement number when you call the board on 011-23813773 or 011-23813845 for an offline claim.
  3. Once sanctioned, check the bank passbook for the monthly credit; the board does not send a separate intimation letter for each month.

Common reasons disability pension claims are rejected

  • Certificate says temporary, not permanent. Rule 275 covers permanent disability only. Ask the medical board to reissue with the correct wording.
  • Cause of disability not stated, so the assessing officer cannot map it to paralysis, leprosy, tuberculosis or accident.
  • Certificate from a private hospital without endorsement by a government medical authority.
  • Membership lapsed at the time the disability occurred.
  • Wrong form. Form XXXIX is the disability pension; Form XLVI is the ex-gratia; Form XXXV is old age pension. Claims filed on the wrong form are returned.
  • Bank account not Aadhaar-seeded, so DBT fails and the file stays pending even after sanction.
  • Name or date of birth mismatch across the registration card, Aadhaar and the medical certificate.

Where a claim is returned, take the corrected paper back to the same counter and have it recorded against the original application number.

Key dates and current position

Disability Pension is open all year and has no application window or last date. File as soon as the permanent disability certificate is in hand. The pension runs from sanction, not from the date of the accident, so delay costs money. Registration with the board, by contrast, must be done before turning 60 and while you are still doing construction work, since the 90-day work condition is tested at registration.

How to raise a grievance

  • Delhi Building and Other Construction Workers Welfare Board: 011-23813773 or 011-23813845.
  • Email: bocwhq.del@gmail.com
  • Office: A-Wing, 7th Floor, Vikas Bhavan-II, Civil Lines, Delhi-110054.
  • Shramik Mitra in your ward, for free help filing and following up.
  • Labour Department, GNCTD, for escalation beyond the board.

The only official charges are Rs 5 for registration and Rs 20 as annual subscription. No agent can charge for a disability claim, and no board official will ask for your OTP or bank password.

Frequently asked questions

How much is the Delhi BOCW disability pension?

The Delhi Building and Other Construction Workers Welfare Board pays Rs 3,000 per month as disability pension to a registered worker who becomes permanently disabled, under Rule 275. A separate one-time ex-gratia of Rs 1,00,000 is also payable for permanent disability.

Which disabilities are covered by the Delhi construction workers board?

Permanent disability caused by paralysis, leprosy, tuberculosis or an accident is covered under Rule 275. The disability must be certified as permanent by a competent government medical authority.

Is there an age limit for the disability pension?

No age condition is stated for the disability pension itself, unlike the old age pension which starts only after 60. What matters is that you were a registered member of the board when the disability occurred and that the disability is certified as permanent.

Which form is used to claim the Delhi BOCW disability pension?

Form No. XXXIX, titled Disability Pension under Rule 275, is the prescribed claim form. The Rs 1,00,000 ex-gratia for permanent disability is claimed on Form No. XLVI. Both are on the Forms page of bocw.delhi.gov.in.

Does the disability have to happen at the construction site?

No. The rule covers permanent disability from paralysis, leprosy and tuberculosis as well as accidents, so an illness unconnected with the worksite is covered. An accident away from the site is also covered as long as the disability is permanent and certified.

Can I get both the disability pension and the ex-gratia?

Yes. The board lists a Rs 3,000 monthly disability pension and a Rs 1,00,000 ex-gratia payment separately under Rule 275, so a permanently disabled registered worker can claim both, on their respective forms.

What happens if the disabled worker dies?

Death benefits become payable to the nominee — Rs 2,00,000 for accidental death and Rs 1,00,000 for natural death, plus Rs 10,000 funeral assistance. A surviving spouse may also claim family pension of 50 per cent or Rs 1,500 a month, whichever is higher.
