What is the Haryana Legal Aid Scheme for SC and Vimukat Jatis?

The Legal Aid Scheme is run by the Directorate of Welfare of Scheduled Castes and Backward Classes, which sits under Haryana's SEWA department (Social Justice, Empowerment, Welfare of Scheduled Castes and Backward Classes and Antyodaya). The scheme pays the fee of an advocate so that a Scheduled Caste or Vimukat Jati resident can fight or defend a court case that they could not otherwise afford.

According to the SEWA department's scheme page, the Legal Aid to Scheduled Castes and Vimukat Jatis scheme runs on a 50:50 sharing basis between the Government of India and the State Government. The purpose named on that page is to provide legal aid to a member of a Scheduled Caste or a Vimukat Jati "for defending and instituting" specified categories of cases. The name is sometimes written locally as Anusuchit Jati evam Vimukt Jati Vidhik Sahayata Yojana.

Two things make this scheme different from a general cash benefit. First, the money is a payment of an advocate's fee at Law manual rates, not a lump sum handed to the applicant. Second, the sanctioning authority changes with the amount: the District Welfare Officer signs off bills up to a limit, and the Deputy Commissioner signs off anything larger.

Who is eligible for legal aid under this Haryana scheme?

You can apply if:

  • You belong to a Scheduled Caste or a Vimukat Jati notified in Haryana and hold a caste certificate issued by a competent Haryana authority.
  • You are a resident of Haryana with a Parivar Pehchan Patra (Family ID).
  • Your case falls in one of the categories the department has listed for the scheme (set out in the next section).
  • You have engaged, or are engaging, an advocate whose fee bill can be placed before the District Welfare Officer.

You cannot apply, or are not eligible, if:

  • You do not belong to a Scheduled Caste or Vimukat Jati community. The scheme as notified names only these two groups; a general Backward Class applicant is not eligible under this head.
  • You are not a resident of Haryana, or the case is outside the state's jurisdiction and its district welfare machinery.
  • Your case is not in the listed categories. Ordinary commercial suits, matrimonial matters not covered by the list, tax appeals and service matters other than reservation-in-services cases are not covered.
  • You are claiming a cash grant rather than an advocate's fee. The scheme has no cash component payable to the litigant.
  • The same advocate's fee has already been paid from another government source, which would make it a double claim.

The department does not publish a numerical income ceiling for this particular scheme. District Welfare Offices in practice ask for an income certificate to confirm that the litigant cannot fund a lawyer privately, so keep one ready.

Which cases does the Haryana legal aid scheme cover?

The SEWA department lists the following categories:

  • Criminal cases instituted on private complaints, and security proceedings under Chapter VIII of the Code of Criminal Procedure, 1898 to both defending and instituting.
  • Ejectment cases from land and other immovable property.
  • Recovery of rent by landlords.
  • Deposit of rent with a Revenue Officer where the landlord refuses to accept rent or refuses to grant a receipt.
  • Correction of khasra girdawari where the entry has been made wrongly by landlords.
  • Right of way or right of usage claims.
  • Forcible removal of dung heaps, a recurring rural dispute in Haryana.
  • Untouchability-related claims for compensation, including denial of access to water sources, refusal of temple entry, and refusal of hostel access.
  • Disputes over the share of agricultural produce.
  • Damages for abduction or enticement of women.
  • Cases about reservation in services filed by Scheduled Caste, Vimukat Jati or Tapriwas employees in court.

If your dispute does not appear on this list, ask the District Welfare Officer in writing before spending on an advocate, because the fee will not be sanctioned later.

How to apply for legal aid under the Haryana SC and BC welfare scheme

  1. Get your papers in order first; caste certificate, Family ID, Aadhaar, bank passbook, and a clear copy of the case papers showing the case number, the court and the opposing party.
  2. Open saralharyana.gov.in and register with your mobile number and email if you do not already have a Saral login. Registration is free.
  3. Search for the legal aid service under the Welfare of Scheduled Castes and Backward Classes department in the Saral service list, and open the application form.
  4. Fill the form and attach scanned documents, including the advocate's vakalatnama or fee bill and the case papers. Check that the caste certificate number is entered exactly as printed.
  5. Submit and save the acknowledgement / Saral ID shown on screen. This is the only number you can track the case with.
  6. Follow up at the District Welfare Office, which verifies the caste status, the category of the case and the fee claimed against Law manual rates.
  7. Collect the sanction. If the bill is up to Rs 22,000, the District Welfare Officer sanctions it. Above Rs 22,000, the file goes to the Deputy Commissioner of the district.

If you do not use the internet, take the same set of documents to any Antyodaya Saral Kendra in your district, where an operator will file the application for you, or to the District Welfare Officer / Tehsil Welfare Officer directly.

How much does the Haryana legal aid scheme pay?

The scheme pays the advocate's fee at the rates prescribed in the Law manual, not a flat amount. The published sanctioning limits are:

  • District Welfare Officer; competent to sanction an advocate's bill of fees up to Rs 22,000.
  • Deputy Commissioner โ€” competent to sanction a fee over and above Rs 22,000, again at Law manual rates.

There is no published upper ceiling beyond the Deputy Commissioner's power, but the fee always has to match the scheduled rate for that class of case. An advocate cannot bill an inflated amount and expect it to be passed.

How do I check the status of my legal aid application?

  1. Log in to saralharyana.gov.in with the mobile number you registered with.
  2. Open Track Application Status and enter your department, service and the Saral reference ID from your acknowledgement.
  3. Alternatively, use the Track Ticket / SMS facility on the Saral portal.
  4. For anything the portal does not show, contact the District Welfare Officer of your district, who holds the physical file.

Why do legal aid applications get rejected in Haryana?

  • Case category not on the approved list, the most common reason. Only the categories named by the department qualify.
  • Caste certificate defects, wrong spelling, expired validity, or a certificate issued outside Haryana.
  • Family ID mismatch, where the name or address on the Parivar Pehchan Patra does not match the Aadhaar or the caste certificate.
  • Fee bill above Law manual rates, which is reduced rather than rejected, so the applicant ends up paying the difference.
  • Incomplete case papers, especially a missing case number or an unsigned vakalatnama.
  • Application filed after the fee has been fully paid privately without any supporting bill or receipt trail.

Fixes are usually administrative: correct the Family ID entry through the meraparivar.haryana.gov.in update flow, get a fresh caste certificate through Saral, and refile with the corrected papers.

Where do I complain if the legal aid application is stuck?

  • Directorate of Welfare of Scheduled Castes and Backward Classes, Bays No. 53-54, Kalyan Bhawan, Sector 2, Panchkula-134109 to phone 0172-2564006 and 0172-2567009, email dbcharyana[at]gmail[dot]com.
  • Atrocity helpline: 0172-2561250, operating 24 hours for atrocity-related calls only.
  • Antyodaya Saral helpline: 0172-3968400, and toll-free 1800-2000-023, for problems with the online application itself.
  • District Welfare Officer of your district for the file itself, and the Deputy Commissioner where the sanction exceeds Rs 22,000.

Separately, every Scheduled Caste litigant in India is entitled to free legal services under Section 12 of the Legal Services Authorities Act, 1987. If this departmental scheme does not cover your case, approach the District Legal Services Authority in your district court complex, which can appoint a panel advocate at no cost. The two routes are independent and asking one does not stop you from asking the other.

Frequently asked questions

What does the Haryana Legal Aid Scheme for SC and Vimukat Jatis actually pay for?

The scheme pays the advocate's fee for an eligible court case at the rates prescribed in the Haryana Law manual. The District Welfare Officer can sanction a bill of fees up to Rs 22,000, and the Deputy Commissioner is the competent authority for any amount above Rs 22,000. The money is a payment of legal fees, not a cash grant to the applicant.

Who can get legal aid under this Haryana scheme?

Members of Scheduled Castes and Vimukat Jatis resident in Haryana can get legal aid under this scheme. According to the SEWA department, the scheme covers defending and instituting a defined list of criminal, civil and revenue cases, and is funded on a 50:50 basis between the Government of India and the Government of Haryana.

Which types of cases are covered?

Covered cases include criminal cases started on private complaints, security proceedings under Chapter VIII of the Code of Criminal Procedure, ejectment from land or other immovable property, recovery of rent by landlords, deposit of rent with a Revenue Officer, correction of khasra girdawari, right of way disputes, forcible removal of dung heaps, untouchability-related claims such as denial of water, temple or hostel access, disputes over the share of agricultural produce, damages for abduction or enticement of women, and cases about reservation in services.

How do I apply for legal aid in Haryana?

Apply online at saralharyana.gov.in or at any Antyodaya Saral Kendra, which is the route the SEWA department names on its scheme page. You can also approach the District Welfare Officer or Tehsil Welfare Officer of your district with the case papers and the advocate's fee bill.

Is this the same as free legal aid from the Legal Services Authority?

No. This is a separate Welfare of SC and BC department scheme that reimburses an advocate's fee for a listed set of cases. Free legal aid and a panel lawyer under the Legal Services Authorities Act, 1987 is a different route run by the Haryana State Legal Services Authority and the District Legal Services Authority, and an SC applicant is entitled to it as well.

Is there any fee to apply?

No. Applying under the Haryana legal aid scheme is free. Antyodaya Saral Kendras may charge a small notified service charge for assisted filing, but no agent can charge for getting a case sanctioned.

Who sanctions the payment and how long does it take?

The District Welfare Officer sanctions advocate fee bills up to Rs 22,000 and the Deputy Commissioner sanctions bills above Rs 22,000. The department does not publish a fixed service timeline for this scheme, so track the application on Saral with the acknowledgement number and follow up with the District Welfare Office.

Can a Backward Class applicant use this scheme?

The scheme as notified names Scheduled Castes and Vimukat Jatis, so a Backward Class applicant who is not from an SC or Vimukat Jati community is generally not eligible under this particular head. Backward Class residents should ask the District Welfare Officer about other Welfare of SC and BC department schemes and about free legal aid from the District Legal Services Authority.
