Legal Heir / Succession Certificate in Haryana
Haryana state government scheme
Legal Heir Certificate in Haryana is issued offline by the Tehsildar or Naib Tehsildar of the deceased's tehsil, not through the Antyodaya SARAL portal, which carries only caste, income, EWS and residence certificates. Inheritance mutation is then recorded on jamabandi.nic.in, and a succession certificate for bank and securities claims comes from the District Court.
Legal Heir Certificate in Haryana is the revenue department's written record of who the surviving heirs of a deceased person are, issued by the Tehsildar or Naib Tehsildar of the tehsil where the deceased ordinarily lived. Haryana handles this differently from the state's other certificates: caste, income, residence and EWS certificates all run through Antyodaya SARAL at saralharyana.gov.in, but the legal heir certificate does not appear on that portal's service list, so the application is made at the tehsil office in person.
What is a legal heir certificate in Haryana and who issues it?
A legal heir certificate names the surviving heirs of a deceased person and their relationship to them. Haryana departments use it to release family pension, gratuity, provident fund balances, leave encashment and insurance dues, to process compassionate appointment, and as supporting evidence for inheritance mutation of land.
The Haryana Revenue and Disaster Management Department issues it through the tehsil establishment. The patwari of the relevant village or urban circle carries out the field verification, the revenue kanungo counter-checks the heir list, and the Tehsildar or Naib Tehsildar signs. Because the enquiry is local, jurisdiction matters: the application goes to the tehsil where the deceased ordinarily resided, not where the heirs now live.
The Antyodaya SARAL platform is Haryana's single window for notified citizen services, and its certificate download page at status.saralharyana.nic.in serves caste, backward class, scheduled caste, EWS, residence and income certificates. The legal heir certificate is not among them. Anyone who tells you it can be downloaded from SARAL is describing a service that does not exist there.
What is the difference between a legal heir certificate and a succession certificate?
This distinction decides which office you walk into, and getting it wrong costs weeks.
A legal heir certificate is an administrative document. It is cheap, it comes from the Tehsildar, and it is sufficient for state government dues, pension branches, employer settlements, small bank balances and the revenue record.
A succession certificate is a judicial order under Sections 370 to 390 of the Indian Succession Act 1925, granted by the District Judge having jurisdiction. It authorises the holder to collect the debts and securities of the deceased, which in practice means bank deposits, fixed deposits, shares, debentures, bonds and mutual fund units. It costs far more, because the court fee is charged as a percentage of the value of the assets under the state's court-fee schedule, and it takes months rather than weeks because the court publishes a citation inviting objections before granting it. Note also that a succession certificate covers movable assets and debts, not immovable property; land and houses pass by inheritance mutation and, where the title is contested, by a civil suit for declaration or partition.
The practical rule in Haryana is this. For a pension file, a PF claim or a mutation, get the legal heir certificate. For a bank refusing to release a large deposit or a demat account, expect to be sent to the District Court.
Who can and cannot apply for a legal heir certificate in Haryana?
Any surviving heir of the deceased can apply, which under the Hindu Succession Act 1956 means the spouse, sons, daughters and mother as Class I heirs, with the applicable personal law deciding for Muslim, Christian and Parsi families. A minor heir applies through a natural guardian. Where several heirs exist, one heir applies and names the rest; all of them appear on the certificate.
You cannot apply if you are not an heir under the personal law that governs the family. A distant relative, a neighbour, a tenant, a business partner or a creditor of the deceased is not eligible, however genuine their interest in the estate. An applicant who cannot establish that the deceased ordinarily resided in that tehsil is not eligible in that tehsil and must file where jurisdiction lies. A person seeking authority to collect large bank deposits or securities is not eligible for that purpose through the revenue route at all and must go to the District Court instead.
What documents are required for a legal heir certificate in Haryana?
The death certificate of the deceased is the foundation of the file. Beyond it, carry the applicant's Aadhaar, identity proof of the deceased, a residence proof fixing the tehsil, and an affidavit on stamp paper listing every surviving heir with age and relationship. A ration card or family register extract helps the patwari cross-check the list. Haryana offices frequently also ask for the Parivar Pehchan Patra family ID even though it is not a formal requirement, simply because the family record is already digitised in the state.
Add the jamabandi or mutation extract for any land the deceased held if the purpose is inheritance mutation, and the deceased's service or pension records if the claim is against an employer.
How to get a legal heir certificate in Haryana
- Register the death and obtain the death certificate from the municipal corporation, municipal council or gram panchayat where the death occurred. Take several attested copies; every subsequent office keeps one.
- Prepare an affidavit on stamp paper naming every surviving heir with age and relationship, get it notarised, and have the other heirs sign a no-objection where they are not applying jointly.
- Visit the tehsil office of the tehsil where the deceased ordinarily resided and ask the reader or the Tehsildar's clerk for the legal heir certificate application form.
- Submit the completed form with the death certificate, identity and residence proofs, the affidavit and the family record, and collect the receipt with the diary number written on it.
- Wait for the patwari's field verification. The patwari visits the village or ward, confirms the heir list locally and files a report to the revenue kanungo.
- Follow up at the tehsil office with the diary number. Once the Tehsildar signs, collect the certificate at the counter and take photocopies before handing the original anywhere.
How do I get inherited land mutated in Haryana?
Haryana runs its land records through the HALRIS and WebHalris systems published at jamabandi.nic.in, which is integrated with property registration for both urban and rural records. The portal carries an online mutation dashboard, a facility to check mutation of deeds and raise objections, view mutation orders, check mutation status, the mutation register and the schedule of mutation fees.
Apply for inheritance mutation at the tehsil with the death certificate, the legal heir certificate and the jamabandi extract of the khewat concerned. The revenue officer enters the case, allows time for objections from co-sharers, and then sanctions the mutation. Track it on jamabandi.nic.in using the khewat, khasra or owner name search, and if a co-sharer objects, the case becomes contested and shifts to a hearing before the revenue officer.
How do I get a succession certificate from the District Court in Haryana?
- Engage a lawyer and file a petition before the District Judge of the district where the deceased ordinarily resided, or where the assets are held, setting out the death, the relationship, the heirs and a schedule of the debts and securities claimed.
- Attach the death certificate, proof of relationship, and documentary proof of each asset, the bank passbook, the fixed deposit receipt, the demat statement or the share certificate.
- Pay the ad valorem court fee, calculated as a percentage of the value of the assets listed under the court-fee schedule applicable in Haryana. Ask the court's copying agency or your counsel for the exact figure for your value slab before filing.
- The court publishes a citation inviting objections from anyone claiming an interest. If nobody objects within the period allowed, the court grants the certificate; if an objection is filed, the matter is heard.
- Collect the certified copy of the certificate and submit it to the bank or company holding the asset.
Case status for district courts in Haryana can be tracked through the eCourts services with the case number issued at filing.
Why do legal heir applications get rejected or stall in Haryana?
The commonest cause is an incomplete heir list. Omitting a married daughter, a second wife's children or a predeceased son's children turns a routine file into a contested one the moment the omitted heir objects. The second commonest cause is jurisdiction, filing in the tehsil where the heirs live instead of where the deceased resided. Other recurring causes are a death certificate whose spelling of the name does not match the ration card or Aadhaar, an affidavit that is not notarised, no proof that the deceased actually resided in that tehsil, and a dispute among the heirs themselves, at which point the Tehsildar will decline to certify and the family has to go to civil court.
What does it cost, and where do I complain?
Pay only the government's own charges: the stamp paper and notary fee for the affidavit, the court fee stamp on the application, and the mutation fee shown on jamabandi.nic.in for the mutation. There is no separate large fee for a legal heir certificate in Haryana. Agents sitting outside tehsil offices routinely quote a few thousand rupees to "get it passed", which is money for a file any heir can submit personally.
For delay or overcharging, start with the Antyodaya SARAL helpline on 0172-3968400, which is the state's citizen service helpline. Escalate within the revenue hierarchy to the Sub Divisional Officer (Civil) and then the Deputy Commissioner of the district, who is the head of revenue administration. Keep the diary number, the receipt and the affidavit copy; every escalation asks for them.
How to check your application status
There is no single online tracker for a legal heir certificate itself in Haryana, because the service is not listed on Antyodaya SARAL and does not carry a portal application number the way caste, income or residence certificates do. Status has to be followed up at the tehsil, but the diary number you were given at submission is what every follow-up step depends on.
- Keep the receipt with the diary number issued when the application was submitted at the tehsil office. This is the only reference the tehsil staff will look up your file by; without it, staff have to search manually through the register for the date you filed.
- Call or visit the tehsil office and ask the reader or the Tehsildar's clerk for the status against that diary number. The three stages a file moves through are: pending with the patwari for field verification, received back from the patwari and awaiting the kanungo's check, or signed and ready for collection at the counter.
- If the file has sat with the patwari beyond the usual few weeks, ask at the tehsil whether the patwari has filed the verification report yet. A stuck file most often means the patwari has not visited the village or ward, or a co-sharer or neighbour has raised an informal objection to the heir list that is holding up the report.
- For a general query rather than a specific file check, the Antyodaya SARAL helpline on 0172-3968400 is the state's citizen service helpline and can point you to the correct tehsil contact, though it does not itself hold legal heir certificate records since the service sits outside SARAL.
- If delay continues past a reasonable period with no explanation, escalate in writing to the Sub Divisional Officer (Civil) of the sub-division, quoting the diary number and the date of filing, and then to the Deputy Commissioner of the district if the SDO stage does not resolve it.
Once the certificate is ready, collect the original in person from the tehsil counter, since it is not issued by post or as a downloadable digital copy, and check the names, ages and relationships printed on it against your affidavit before leaving the counter.
If the same case has since gone to the District Court for a succession certificate over bank deposits or securities, that is a separate track entirely: track the case number on the eCourts services website rather than through the tehsil, since the two offices do not share a common status system.

Frequently asked questions
Can I apply for a legal heir certificate in Haryana on the SARAL portal?
No, Antyodaya SARAL does not carry a legal heir certificate service. The SARAL certificate download page lists caste, backward class, scheduled caste, EWS, residence and income certificates only, so the legal heir certificate has to be applied for at the tehsil office of the tehsil where the deceased ordinarily lived.
What is the difference between a legal heir certificate and a succession certificate in Haryana?
A legal heir certificate is a revenue-department document from the Tehsildar that simply names the surviving heirs, while a succession certificate is a court order under the Indian Succession Act 1925 granted by the District Judge. Haryana employers, pension branches and the revenue department accept the first; banks and companies holding large deposits or shares usually insist on the second.
Who issues the legal heir certificate in Haryana?
The Tehsildar or Naib Tehsildar of the tehsil where the deceased ordinarily resided issues it, after field verification by the patwari and the revenue kanungo. It is a revenue-department document, not a court order.
How do I get inherited land transferred into my name in Haryana?
Apply for inheritance mutation through the Haryana land records system at jamabandi.nic.in, which carries mutation application, mutation status, mutation orders and the mutation register online. The legal heir certificate and the death certificate are the supporting documents, and the mutation is sanctioned by the revenue officer after the objection period.
Do I need a succession certificate for a bank account in Haryana?
Usually yes, once the balance crosses the bank's own threshold for settlement without one. Banks in Haryana settle small balances against a legal heir certificate, an indemnity bond and a no-objection from the other heirs, but for larger deposits, fixed deposits, shares and debentures they ask for a succession certificate from the District Court.
How long does a legal heir certificate take in Haryana?
Timelines are not published as a single statewide number because the certificate is not a notified online service, and the real determinant is how quickly the patwari completes the field report. Applicants should expect several weeks rather than days and should follow up at the tehsil office with the diary number on the receipt.
Does a Haryana legal heir certificate expire?
No, a legal heir certificate has no expiry date because it records a fact about a family that does not change. A fresh certificate is needed only if an heir was omitted, a name is wrong, or another heir dies and the list has to be restated.
How much should I pay an agent for a legal heir certificate in Haryana?
Nothing beyond the government's own charges, which are the stamp paper for the affidavit, the notary fee and the court fee stamp on the application. Agents outside tehsil offices routinely quote several thousand rupees for the same file that a heir can submit personally, and the Antyodaya SARAL helpline on 0172-3968400 takes complaints about overcharging.
