What is Shops and Commercial Establishment Registration in Himachal Pradesh?

Shops and Commercial Establishment Registration in Himachal Pradesh is the labour-law registration a shop, office, hotel, restaurant or other commercial establishment takes from the Department of Labour and Employment, Government of Himachal Pradesh. The department runs a dedicated Licensing & Registration portal at labour.hp.gov.in, and it lists Shops and Commercial Establishment Registration and Renewal first among the services it offers there, ahead of contract labour licensing and building and construction worker registration.

The department describes itself as having come into being as a separate department in 1972, with a labour wing responsible for implementing 28 labour laws, central and state, and Labour Courts-cum-Industrial Tribunals at Shimla and Dharamsala. Its New Himrus Building office on Circular Road, Shimla 171001, is the administrative headquarters for the service.

Himachal Pradesh runs this service as a fully online, form-driven process. The department is explicit that Form-1, Form-6 and Form-7 are online-generated e-forms "submitted in online mode only through the web application", there is no paper set to assemble, no photograph of the shop board to attach, and no separate document bundle. What you supply is the information in the e-forms and the fee.

The registration certificate is what a bank in Shimla, Solan, Mandi or Kangra accepts as constitution proof for a proprietor's current account, what landlords and aggregators ask for during onboarding, and what brings the establishment onto the department's rolls. It is separate from GST registration and from Udyam registration, and, importantly in Himachal, from the trade licence issued by the urban local body.

Who can and cannot apply in Himachal Pradesh?

You can apply if:

  • You run a shop in Himachal Pradesh, retail or wholesale trade in goods, or premises where services are rendered to customers.
  • You run a commercial establishment, an office, a trading or broking office, a consultancy, an IT firm or a godown attached to a business.
  • You run a hotel, restaurant, eating house or place of public entertainment in the state.
  • You are the employer, the proprietor, a partner, a director or someone authorised to act as employer.
  • Your establishment employs no person at all. Himachal's very first fee slab is "Establishment employing no person" at Rs 50, so a one-person shop still registers, and cheaply.
  • You already hold a certificate and need to renew it. Renewal runs on the same portal, with the same three forms and the same fee schedule.

You cannot apply, or are not eligible on this service, if:

  • You are an employee. Only the employer registers the establishment.
  • Your unit is a factory under the Factories Act, which the department licenses and renews as a separate service: Himachal also runs a dedicated Online Factory Registration Information System (OFRIS).
  • Your requirement is contract labour registration or licensing, migrant workmen registration, motor transport worker registration or BOCW registration, each of which the department runs as a distinct service with its own fee schedule.
  • The activity is not commercial. A household employing domestic help is not an establishment.
  • You want only a trade licence. That is a municipal approval issued by the Municipal Corporation, Municipal Council or Nagar Panchayat, and the department's own checklist requires you to hold a valid shop licence first.

What does registration cost in Himachal Pradesh?

The department publishes one fee schedule that applies identically to registration and renewal.

Category of establishment Fee for registration / renewal
Establishment employing no person Rs 50
Establishment employing up to 5 persons Rs 200
Establishment employing more than 5 but less than 11 persons Rs 300
Establishment employing more than 10 but less than 26 persons Rs 500
Establishment employing more than 25 persons Rs 2,000

The department's own FAQ confirms two things worth knowing: there is a fee, and it varies from service to service; and the department accepts payment through Treasury. The service delivery process adds that at the application step you "select the payment mode and make the payment online through the Payment Gateway using Net-banking, credit/debit card etc".

That is the whole cost. A Himachal shopkeeper with four employees pays Rs 200 to register and Rs 200 again to renew. Pay it on labour.hp.gov.in itself. An agent quoting a consolidated four-figure fee for the same three e-forms is charging for form-filling, not for a government levy, and Himachal generates those forms for you inside the portal.

What documents are required?

Himachal Pradesh does not ask for a conventional document bundle. Its published requirement is a set of e-forms:

Item Registration Renewal Amendment
Form-1 Yes Yes Yes
Form-6 Yes Yes Yes
Form-7 Yes Yes Yes
Form-4 — ; Yes

All of them are described as online generated e-forms submitted in online mode only through the web application. Amendment of an existing Registration Certificate adds Form-4 to the same three. The portal will, at the upload step in its service delivery process, let you "attach the necessary set of supporting documents (as required)", so keep identity proof of the employer and proof of the premises scanned and ready in case the Labour Inspector asks, but the department's formal list is the four forms above.

How to apply for Shops and Commercial Establishment Registration in Himachal Pradesh

The department's Service Delivery Process document sets out the sequence:

  1. Open labour.hp.gov.in to reach the online application for Registration of Shops and Commercial Establishment.
  2. Register as a new user if you do not have an account. Click "Register New User" on the home page, enter all necessary information, click Submit, and once the account is activated use that user ID and password to log in.
  3. Log in and select the service from the list of services in the application, then fill in the necessary details. The application is submitted as an e-form through the web portal.
  4. Attach any supporting documents required, select the payment mode, and make the payment online through the payment gateway using net-banking or a credit or debit card.
  5. Note the unique service request ID, which the portal generates on submission and sends to your email or mobile.
  6. Wait for the Labour Inspector's review. The application is routed to the competent authority. The Labour Inspector, on location-based jurisdiction. The Inspector may approve it (creating an electronic copy of the licence with the Inspector's digital signature, updating the record with a Unique Certificate ID), reject it with rejection comments, or revert it to you for additional documents or updated information.
  7. Receive the automated SMS and email alert. If the application is rejected you are told the reason; if approved, an alert tells you the certificate is ready.
  8. Download the certificate from the application. It is also emailed to you if an email ID is on record, and the department will send the licence by post if you want it.

How long does it take, and how do I check status?

Himachal Pradesh has a mandated timeline of 15 days after completion of all codal formalities for approval of a complete application. The department notes this was mandated through the Public Service Delivery Guarantee Act vide notification No. Shram (A)6-2/10-Part-File-1-L dated 27 February 2016.

Check status by logging directly into the online application with your user ID and password and searching on your unique application request number. The department's own process document lists this as the status route for both registration and renewal. The portal home page also carries a Dashboard and a Verify Certificate option, the latter letting anyone confirm a certificate is genuine.

What about the trade licence, and how does it connect?

Himachal links the two approvals deliberately. The department's trade licence checklist asks for just two things: a copy of a valid shop licence and the Shops and Commercial Establishment Licence Number. The portal offers a combined route, you select either the trade licence or the "Shop & Commercial Establishment Registration cum trade license", and in the latter case you first fill the shop and establishment information and pay the required fee, then proceed to the trade licence.

Trade licence fees are set separately: the Executive Officer or Secretary decides them from time to time, calculated as the annual licence fee rate multiplied by the number of years requested. The published scale is Rs 100 a year for small-scale business or trade, Rs 200 for medium and Rs 500 for large, with multi-year rates of Rs 400 / Rs 800 / Rs 2,000 for five years, Rs 700 / Rs 1,400 / Rs 3,500 for ten years and Rs 1,300 / Rs 2,600 / Rs 6,500 for fifteen years. For fairs, the rate is Rs 25 a day for a small shop, Rs 50 for medium and Rs 100 for a large shop.

The trade licence then travels through the urban local body: after verification it goes to the Junior Engineer, then the Municipal Engineer, and finally to the Commissioner in a Municipal Corporation, the Executive Officer in a Municipal Council, or the Secretary in a Nagar Panchayat, who issues the final certificate for you to download.

Why do applications get reverted or rejected in Himachal Pradesh?

The department builds a formal revert step into its process, and it is used more often than outright rejection. The usual triggers are a headcount that does not match the fee slab paid, an incomplete e-form, supporting documents the Inspector asks for that were not attached, or an objection raised by another authority during the linked trade licence flow. The department's own note says that at each step, if an application is incomplete or any objection arises, it goes back to the applicant for correction or modification. Fix the specific point in the Inspector's comment and resubmit, rather than starting a fresh application and paying again.

Where do I complain if the application is stuck?

The Labour Department portal publishes a toll-free helpline, 1800 180 8076, and the email helpdesk.edistrict.itl@gmail.com for queries. The portal also carries a Feed Back section and a Contact Us directory PDF for the department's offices. Because the 15-day timeline flows from the Public Service Delivery Guarantee Act, a complete application still undecided after 15 days is exactly the kind of case that Act exists to escalate, quote your unique service request ID and the date of submission.

Himachal Pradesh charges Rs 50 to Rs 2,000 for this registration and generates every form inside the portal. There is nothing here that needs a middleman, and no amount above the published slab is a government charge.
