Encumbrance Certificate in Jammu and Kashmir (Department of Registration and NGDRS J&K)
Jammu and Kashmir state government scheme
An Encumbrance Certificate in Jammu and Kashmir is obtained from the Department of Registration, which runs 86 Sub-Registrar offices and registers documents online through NGDRS at ngdrs.jk.gov.in. Applicants file at the Sub-Registrar or Deputy Commissioner's office with a non-judicial stamp affixed, and the NGDRS helpline is 0191-2572728.
What is an encumbrance certificate in Jammu and Kashmir?
An encumbrance certificate in Jammu and Kashmir is a statement from the Department of Registration confirming what has been registered against a property during the period searched, or confirming that nothing has been. An encumbrance is a registered claim that limits an owner's freedom to sell clean: a bank mortgage, a court attachment, a registered lease, a gift, a partition, a release or an earlier sale.
The Department of Registration, Government of Jammu and Kashmir was established on 24 October 2019, following the Jammu and Kashmir Reorganisation Act, 2019, and works under the administrative control of the Revenue Department. It currently manages 86 Sub-Registrar offices across the Union Territory.
Jammu and Kashmir is a comparatively new entrant to online registration, and that history shapes everything about how an EC works here. According to the department, NGDRS was launched on 18 September 2020 in five districts, Jammu, Samba, Kathua, Udhampur and Srinagar, covering 24 Sub-Registrar offices, and was extended to the remaining 15 districts on 9 November 2020. The practical consequence for a buyer is blunt: the digital register begins in late 2020, and anything registered before that sits in the physical registers of the Sub-Registrar Office.
Which portals does J&K use?
The Department of Registration publishes three online services on igr.jk.gov.in:
- NGDRS J&K at ngdrs.jk.gov.in, the National Generic Document Registration System instance for the Union Territory, used for online document registration, citizen registration and login, appointments and searching registered documents.
- e-Stamping through SHCIL at shcilestamp.com, for stamp duty on the instrument being registered.
- JK-GRAS at jkgras.jktreasury.gov.in, the government receipt accounting system used for electronic payment of registration fees.
Jammu and Kashmir does not issue a numbered "Form 15" or "Form 16" encumbrance certificate. That numbering belongs to Karnataka, Tamil Nadu, Telangana and Andhra Pradesh. In J&K the same information comes out as a certificate or search report signed at the Sub-Registrar's office.
Who can apply for an EC in Jammu and Kashmir?
You can apply if:
- You are the owner of the land, house, shop or plot.
- You are a prospective buyer verifying the property before paying advance money.
- You are a bank or financial institution processing a loan against the property, or an advocate issuing a title opinion.
- You are a legal heir establishing what a deceased relative owned and what charges attach to it.
- Registered documents are public records under the Registration Act, so a person with an interest in the property may apply. The counter, in practice, asks for your identity proof and the property's title document.
You cannot apply if:
- You cannot search without a property identifier. A khasra number with khewat or khata, village, tehsil and district, or the plot and house number for urban property, is essential. An address alone will not do.
- You cannot obtain a purely online certificate. J&K's encumbrance application is a counter process with a stamped application, even though registration itself is online.
- You cannot find pre-2020 entries in the digital register. Those years need a manual search of the physical registers at the Sub-Registrar Office.
- You cannot find unregistered dealings, an unregistered agreement, an oral family arrangement or a pending suit not registered as an attachment.
How to apply for an encumbrance certificate in Jammu and Kashmir
- Identify the jurisdictional office. Work out which of the 86 Sub-Registrar offices covers the tehsil where the property lies. The application is filed at the Sub-Registrar, or at the respective Divisional or Deputy Commissioner's office, depending on the district's practice.
- Collect the application form for the Encumbrance Certificate at that office, or download it where the district administration publishes it online.
- Fill in the property details completely — khasra number, khewat or khata number, village, tehsil, district, extent and boundaries, and the exact period to be searched. State 13 years for a bank requirement and 30 years for a full title trace.
- Affix the non-judicial stamp on the application. This is a specific J&K requirement and an application without it will be returned at the counter.
- Attach the supporting documents. A copy of the registered sale deed or title document, and your photo identity proof.
- Pay the applicable fee, using the JK-GRAS electronic payment route at jkgras.jktreasury.gov.in where the office directs, and keep the challan.
- Submit the application and take the acknowledgement with the application number on it.
- Collect the certificate from the same office on the date given. Keep the acknowledgement, because it is the only way the office can trace your file.
How to search registered documents on NGDRS J&K
- Open ngdrs.jk.gov.in and register as a citizen user with your mobile number and email, or log in if you already have an account.
- Use the search facility for registered documents, entering the district, the Sub-Registrar Office and the property or document particulars the form asks for.
- Read the results as the list of documents registered on NGDRS since the portal went live in your district to 18 September 2020 for the first five districts, 9 November 2020 for the remaining fifteen.
- Treat the result as a starting point, not a certificate. For anything a bank or a court will rely on, file the counter application for the certificate.
How do I check status and get support?
- By phone: the Department of Registration office helpline 0191-2572728.
- NGDRS technical support: the department publishes named NGDRS support contacts on igr.jk.gov.in for portal and registration problems.
- Grievance portal: NGDRS carries a grievance portal for technical issues.
- In person: at the Sub-Registrar or Deputy Commissioner's office with your acknowledgement number.
- Escalation: the Sub-Registrar, then the district Registrar, then the Department of Registration, and above it the Revenue Department, Government of Jammu and Kashmir.
How long is a J&K encumbrance certificate valid?
An encumbrance certificate in Jammu and Kashmir carries no expiry date, but it is only true up to the last date of the period it covers. A mortgage registered the day after the search period ends will not appear.
Banks and buyers' advocates in J&K therefore want a recently issued certificate, usually weeks rather than months old, and a careful buyer applies for a short top-up search covering the intervening period immediately before the sale deed is registered. There is no renewal procedure. You apply afresh for the new period.
Why do J&K encumbrance applications fail?
- No non-judicial stamp on the application, which gets it rejected at the counter before it is even read.
- Wrong Sub-Registrar office, so the search returns nothing and is read falsely as a clean record.
- Wrong khasra or khewat number, particularly after partition of joint holdings where the numbering has been subdivided.
- Expecting the online register to cover old years. NGDRS in J&K starts in late 2020; a 30-year trace is largely a manual search.
- Ignoring a mortgage with no release entry. A loan repaid but never released in the register still shows as a live charge.
- Skipping the revenue-side checks. In J&K the jamabandi, girdawari, fard and the mutation entry with the Tehsildar matter at least as much as the registration record, and land-use and agricultural-land restrictions apply.
What does it cost, and what should you refuse to pay?
Pay only the fee published by the Department of Registration. The fee structure is available under the Publications section of igr.jk.gov.in, and pay it through JK-GRAS or at the counter against a receipt. Stamp duty on instruments goes through e-stamping via SHCIL, not through any individual.
Agents and document writers outside Sub-Registrar offices in Jammu and Srinagar offer to "arrange" a certificate quickly. They are filing the same stamped application at the same counter. No officer can create or delete an entry in the register for money, and there is no paid priority queue. File it yourself, keep the receipt and the acknowledgement, and never hand your NGDRS login or OTP to an agent.

Frequently asked questions
Which department issues the encumbrance certificate in Jammu and Kashmir?
The Department of Registration, Government of Jammu and Kashmir, which works under the administrative control of the Revenue Department and runs 86 Sub-Registrar offices across the Union Territory. The department was established on 24 October 2019 following the Jammu and Kashmir Reorganisation Act, 2019.
Is there a fully online encumbrance certificate in J&K?
Not in the way Karnataka or Andhra Pradesh offer one. Document registration in J&K runs online through NGDRS at ngdrs.jk.gov.in, and citizens use the portal to search registered documents, but the encumbrance certificate itself is applied for at the Sub-Registrar or Deputy Commissioner's office with a stamped application.
Since when has online registration been available in Jammu and Kashmir?
NGDRS was launched in J&K on 18 September 2020 in five districts — Jammu, Samba, Kathua, Udhampur and Srinagar — across 24 Sub-Registrar offices, and was extended to the remaining 15 districts on 9 November 2020. Documents registered before those dates exist only in the physical registers.
Does J&K issue Form 15 and Form 16 encumbrance certificates?
No, the Form 15 and Form 16 numbering is used in Karnataka, Tamil Nadu, Telangana and Andhra Pradesh, not in Jammu and Kashmir. The J&K Registration Department issues the equivalent as a certificate or search report from the Sub-Registrar based on the register.
How do I pay the fee?
Registration fees in Jammu and Kashmir are paid electronically through JK-GRAS, the government receipt accounting system at jkgras.jktreasury.gov.in, and stamp duty through e-stamping via SHCIL at shcilestamp.com. The Department of Registration publishes its fee structure under the Publications section of igr.jk.gov.in — check it before paying.
Whom do I call if NGDRS J&K is not working?
Call the Department of Registration office helpline on 0191-2572728. The department also publishes NGDRS technical support contacts on igr.jk.gov.in for portal and registration problems.
Can anyone apply for an EC, or only the owner?
Anyone with a legitimate interest can apply — the owner, a prospective buyer, a bank, an advocate or a legal heir — because registered documents are public records. In practice the J&K counter application asks for the applicant's identity proof and the property's title document, so carry both.
Does an EC prove ownership of land in J&K?
No, an encumbrance certificate records registered transactions, not ownership. A J&K title check also needs the jamabandi and girdawari from the Revenue Department, the mutation entry with the Tehsildar, the fard, and the chain of registered deeds.
