Legal Heir / Succession Certificate in Ladakh
Ladakh state government scheme
Legal heir proof in Ladakh comes from the Revenue Department, the Tehsildar of your tehsil, under the Deputy Commissioners of Leh and Kargil. Ladakh runs online citizen services through ladakh.gov.in, an e-Seva portal and the national ServicePlus platform at serviceonline.gov.in, on which Ladakh is a listed union territory. A succession certificate for bank and share claims comes separately from the District Court.
Legal Heir / Succession Certificate in Ladakh runs on the revenue machinery the Union Territory inherited from Jammu and Kashmir when it was constituted on 31 October 2019. The Revenue Department issues the administrative legal heir certificate through the Tehsildar, under the Deputy Commissioners of Leh and Kargil. Anything that involves actually collecting the deceased's money; bank balances, fixed deposits, shares, provident fund arrears above the institution's own threshold; requires a succession certificate from the District Court under the Indian Succession Act, 1925. Ladakh families routinely spend weeks on the first when the bank was always going to demand the second.
Which department issues legal heir proof in Ladakh?
The Revenue Department of the UT Administration of Ladakh issues it, and the signing officer is the Tehsildar of the tehsil where the deceased ordinarily resided. Ladakh has two districts, Leh and Kargil, each headed by a Deputy Commissioner who is also the District Collector, and beneath them the familiar Jammu and Kashmir revenue chain: Patwari at the field level, Girdawar supervising, Naib Tehsildar endorsing, Tehsildar signing.
The UT publishes citizen services on ladakh.gov.in, which carries an Online Citizen Services section, a Ladakh Citizens Help Hub at helphub.ladakh.gov.in, an e-Seva portal, a higher education portal and the Ladakh heli booking service. Ladakh is also a listed union territory on the national ServicePlus platform at serviceonline.gov.in, which is where many UT revenue services are delivered. At district level, leh.nic.in lists Revenue Department, Law and Justice, District Court, Food and Civil Supplies, Social Welfare and "Apply for Death Certificate" among its citizen service links, and Kargil district publishes its own service pages that tell applicants to download the form and approach the Tehsil Office at Baroo, Kargil.
What that adds up to in practice: the death certificate and several revenue certificates have genuine online routes, while the legal heir certificate itself is most reliably obtained at the Tehsil counter. Check the Online Citizen Services link on ladakh.gov.in first, because Ladakh has been migrating services onto the portals steadily since 2020, but plan for the counter.
Who can and cannot apply for a legal heir certificate in Ladakh?
You can apply if you are a surviving heir or dependent of a deceased person who was resident in a Ladakh tehsil, spouse, son, daughter, mother or father are the standard categories, and a guardian may apply on behalf of a minor heir named in the affidavit. Families of deceased government servants and pensioners are the largest group, because family pension, gratuity, provident fund arrears and compassionate appointment all require the Revenue Department to certify who the survivors are.
You apply to the tehsil where the deceased lived, not where you now live. For a family from a remote tehsil, Nubra, Changthang, Zanskar, Drass, Sankoo, Taisuru, that is the tehsil of record, and jurisdiction is not negotiable even when the journey is long.
You cannot apply if you are not an heir or dependent of the deceased. A creditor, business partner, tenant or friend has no standing here whatever documents they hold. You cannot use a legal heir certificate to make a bank release a large deposit or a company transfer shares, those institutions are entitled to insist on a court succession certificate, and the Tehsildar's certificate does not override that. You are not eligible to use this route where the deceased left a valid will, because a will is proved by probate or letters of administration in the District Court. And a legal heir certificate does not decide shares: shares follow the applicable personal law — Muslim personal law for much of Kargil, Hindu and Buddhist succession law in Leh, and where the shares are disputed, the civil court decides, not the Tehsildar.
What documents does the Tehsil office need?
Carry the complete set in one visit. Travel in Ladakh is expensive in time and, for several months of the year, in road access.
The death certificate comes first, and Leh district lists an application route for it among its own citizen services. The affidavit naming every surviving heir is the core document: each survivor's name, age and relationship, and an express statement that nobody has been left out. Getting this wrong is the biggest legal exposure in the process, because an omitted heir has a direct remedy against the person who swore the affidavit.
Add proof of residence in the tehsil, identity proof for the applicant and every heir named, and the ration card or family record, that last is the document the Tehsil office cross-checks the affidavit against, and a discrepancy between them is the most common reason a file is returned.
The Patwari's report is generated inside the office rather than brought by you, but it is a required part of the file, and it is the step that determines your timeline. Where the claim is a service benefit, add the service book extract or Pension Payment Order.
How to apply for a legal heir certificate in Ladakh
- Obtain the death certificate. Register the death if it is not already registered, and apply through the district administration's service page or at the registrar's office. Keep the original and several attested copies.
- Get the affidavit drawn and sworn on stamp paper, listing every surviving heir with age and relationship and declaring that no heir has been omitted. Have it attested before a notary or magistrate.
- Check the Online Citizen Services link on ladakh.gov.in and the ServicePlus platform at serviceonline.gov.in to see whether the legal heir certificate is currently live online for your district. If it is, register with your mobile number, complete the form and upload the scanned enclosures.
- Otherwise, collect the prescribed application form at the Tehsil office of the tehsil where the deceased resided, or download it from the district administration website as Kargil district instructs for its revenue certificates.
- Submit the complete file at the Tehsil counter with the death certificate, affidavit, residence proof, identity proofs of all heirs and the ration card or family record. Pay whatever fee the office charges and insist on a dated receipt and acknowledgement.
- Cooperate with the Patwari's field verification. The Patwari visits or calls to confirm the family composition; the Girdawar and Naib Tehsildar endorse the report, and the Tehsildar then signs. Being reachable at this stage is the single biggest thing you control.
- Collect the signed certificate from the Tehsil office, or download it if you applied online, and check every name and spelling before you leave the counter.
How to get a succession certificate from the District Court in Ladakh
- Confirm you actually need one. Ask the bank, provident fund office or share registrar in writing what it requires. Many settle modest balances against a nomination, an indemnity bond and a legal heir certificate, and demand a court certificate only above their own threshold.
- File a petition under Part X of the Indian Succession Act, 1925 in the District Court with jurisdiction over Leh or Kargil, listing the deceased's debts and securities item by item and naming every heir as a party. Leh district's services page links District Court and Law and Justice, which is the right starting point.
- Pay the ad-valorem court fee calculated on the value of the debts and securities. It scales with the estate, which is why a court certificate is far more expensive than a Tehsildar's certificate.
- Await the citation period. The court issues a general citation inviting objections and a statutory waiting period runs before the certificate can be granted. Uncontested petitions commonly take several months, and Ladakh's winter court calendar and travel conditions can extend that.
- Collect the certificate and present it to the institution named in it. It authorises collection only of the debts and securities specified, so an asset you forgot to list is not covered by it.
How do I check the status of my application?
If you applied online through the Online Citizen Services route or ServicePlus, track the application with the acknowledgement number the portal generated, ServicePlus provides application tracking for every service it carries. If you applied at the counter, the acknowledgement receipt and the Tehsil office itself are your handles, and the useful question to ask is which stage the file is at: Patwari report, Naib Tehsildar endorsement, or awaiting the Tehsildar's signature.
The Ladakh Citizens Help Hub at helphub.ladakh.gov.in is the UT's own assistance channel for citizens navigating these services. A court petition is tracked separately, by case number, through the court's case information system.
Why do Ladakh applications get rejected or stall?
The commonest single cause is pending Patwari verification, which is a delay rather than a rejection but accounts for most of the elapsed time. In winter, verification for remote tehsils genuinely waits on road access.
Second is an affidavit that omits an heir, a married daughter, a mother of the deceased or a child from an earlier marriage are the usual omissions, and the ration card cross-check exposes them immediately. Third is name and spelling mismatch across the death certificate, ration card, identity documents and affidavit, which is worth correcting before submission rather than after.
Fourth is wrong jurisdiction: the certificate must be sought in the tehsil where the deceased resided. Fifth is the wrong document altogether, a family obtains a legal heir certificate for a bank deposit that will only be released against a court succession certificate. Ask the institution in writing first.
Where do I complain if the certificate is delayed?
Escalate within the revenue chain first: from the Tehsildar to the Sub-Divisional Magistrate, then to the Deputy Commissioner of Leh or Kargil, quoting your acknowledgement number and the date of submission. The Deputy Commissioner is both the head of the district revenue administration and the natural escalation point.
The Ladakh Citizens Help Hub at helphub.ladakh.gov.in is the UT's published citizen assistance platform, and the central CPGRAMS portal at pgportal.gov.in accepts grievances against UT departments with the acknowledgement attached.
One thing to hold on to: this is a government counter service, charged at whatever the Tehsil office or the portal publishes and receipts, and the Patwari's verification is a statutory step that no payment can shorten. The Administration of Ladakh authorises no private agent to file, follow up or collect this certificate for a fee.

Frequently asked questions
Who issues a legal heir certificate in Ladakh?
The Tehsildar of the tehsil where the deceased resided issues it, under the Deputy Commissioner of Leh or Kargil. Ladakh inherited the Jammu and Kashmir revenue structure at reorganisation in October 2019, so Patwari, Girdawar, Naib Tehsildar and Tehsildar are the working chain, and the Revenue Department is the issuing department.
Can I apply for a legal heir certificate online in Ladakh?
Ladakh runs online citizen services through ladakh.gov.in, an e-Seva portal and the national ServicePlus platform at serviceonline.gov.in, where Ladakh is a listed union territory. Whether the legal heir certificate itself is live online varies by district and by time, so check the Online Citizen Services link on ladakh.gov.in before travelling, and be prepared for the Tehsil office route.
What is the difference between a legal heir certificate and a succession certificate?
A legal heir certificate is an administrative document from the Revenue Department recording who survived the deceased, while a succession certificate is a court order under Part X of the Indian Succession Act, 1925 that authorises the holder to collect the deceased's debts and securities. Banks, provident fund offices and share registrars beyond their own small-claim limits require the court certificate.
Which court issues a succession certificate in Ladakh?
The District Court with jurisdiction over Leh or Kargil hears succession certificate petitions, under the High Court of Jammu and Kashmir and Ladakh. Leh district's own services page lists District Court and Law and Justice among its citizen service links, which is the right starting point.
What does a legal heir certificate cost in Ladakh?
No consolidated UT-wide fee schedule for this certificate is published on ladakh.gov.in, so ask at the Tehsil counter what the charge is and insist on a receipt. Stamp paper for the affidavit is a separate stamp-vendor cost. Court fee for a succession certificate is separate again and scales with the value of the debts and securities claimed.
How long does it take in Ladakh?
No UT-wide service standard for this certificate is published, and the practical timeline in Ladakh depends heavily on the Patwari's field verification, which in winter can be slowed by road closures to remote tehsils in Zanskar, Nubra, Changthang and Drass. Ask the Tehsil office for an expected date at the time of submission and write it down.
Does a Ladakh legal heir certificate expire?
No fixed validity is published, because the certificate records a fact — who survived the deceased — rather than a status that lapses. Departments and banks still commonly ask for a recently issued copy, and a fresh certificate is needed if a listed heir dies or a new heir is established after issue.
Should I pay an agent to arrange this in Ladakh?
No — apply at the Tehsil counter or through the Online Citizen Services link on ladakh.gov.in and pay only what the office or the portal charges, against a receipt. Verification by the Patwari is a statutory step nobody can buy their way past, and an agent quoting a large fee to "speed it up" is selling you a queue you can join yourself.
