Legal Heir Certificate in Madhya Pradesh (Waris / Uttaradhikar Praman Patra) (Madhya Pradesh): An official Madhya Pradesh Revenue Department

Madhya Pradesh state government scheme

Quick answer

A legal heir certificate in Madhya Pradesh is the Waris or Uttaradhikar Praman Patra recorded by the Tehsildar of the tehsil where the deceased last lived. Applications are filed at a Lok Seva Kendra, an MP Online kiosk or a CSC, and the linked land-record mutation is processed as the undisputed namantaran service on the Revenue Case Management System at rcms.mp.gov.in.

Benefit
An official Madhya Pradesh Revenue Department record of the surviving heirs of a deceased person, used for family pension, provident fund, gratuity, insurance claims and undisputed mutation of land records
How to apply
Both, at a Lok Seva Kendra, MP Online kiosk or CSC, and at the Tehsildar's office; the connected mutation case runs online on RCMS

What is a legal heir certificate in Madhya Pradesh?

A legal heir certificate in Madhya Pradesh, the Waris Praman Patra or Uttaradhikar Praman Patra: is a Revenue Department record naming the surviving heirs of a person who has died. The Tehsildar of the tehsil in which the deceased last resided is the officer who makes that record, acting on the report of the Patwari and the Revenue Inspector for the village or ward.

Madhya Pradesh delivers citizen services through Lok Seva Kendras, MP Online kiosks and Common Service Centres, with the notified service list and time limits published on the Lok Seva portal at mpedistrict.gov.in under the Madhya Pradesh Public Services Guarantee Act, 2010, the first legislation of its kind in India, covering hundreds of notified services with statutory time limits and an appeal when they are missed.

Separately, Madhya Pradesh runs the Revenue Case Management System (RCMS) at rcms.mp.gov.in, where revenue cases are filed and tracked online. The Lok Seva service list carries undisputed namantaran (RCMS), the mutation that removes a deceased owner's name from the khasra and khatauni and substitutes the heirs' names. For a land-owning family in Madhya Pradesh, the heirship record and the namantaran case are two halves of the same job.

What is the difference between a Waris certificate and a succession certificate?

Two different documents exist, issued by two different authorities, for two different purposes.

  • The Waris / legal heir certificate is administrative. A revenue officer, the Tehsildar, records who survived the deceased. It is accepted for family pension, gratuity, provident fund, arrears of salary, compassionate appointment, transfer of utility connections and mutation of land records.
  • A succession certificate is judicial. The competent civil court issues it under Part X of the Indian Succession Act, 1925, and it authorises the person named to receive the debts and securities of the deceased, fixed deposits, shares, debentures, bonds and mutual fund units. The court charges an ad valorem court fee on the value of those assets and publishes a notice inviting objections, so it takes months and needs an advocate.

Ask the bank, insurer or employer in writing which of the two they will accept before spending money on either. Where the estate is immovable property and the heirs disagree, neither document decides the dispute: that is a partition suit, or a probate or letters of administration application where a will exists.

Who can apply in Madhya Pradesh, and who cannot?

The following can apply:

  • The surviving spouse of the deceased.
  • Sons and daughters, including married daughters and legally adopted children.
  • The mother and father of the deceased.
  • Grandchildren claiming through a predeceased son or daughter.
  • A natural guardian applying on behalf of a minor heir.

Madhya Pradesh applies no income limit, no caste condition and no minimum residence period, because this is a record of fact and not a welfare entitlement.

The following cannot apply and are not eligible:

  • Relatives outside the class of heirs recognised by the personal law of the deceased, a nephew, cousin, in-law, tenant or friend cannot apply.
  • Anyone where the deceased left a registered will; the executor must apply to court for probate instead.
  • Applicants where the deceased last lived outside Madhya Pradesh and held no land in the state.
  • Applicants where an objection or a rival claim is already pending. A contested heirship converts the namantaran into a disputed revenue case, and the Tehsildar decides it as a court after hearing both sides rather than issuing a routine certificate.

How to apply for a legal heir certificate in Madhya Pradesh

  1. Collect the death certificate from the nagar nigam, nagar palika or gram panchayat that registered the death. Check that the name and address match the deceased's Aadhaar and Samagra record before you go further.
  2. Prepare an affidavit on stamp paper listing every surviving heir by name, age and relationship, and get it notarised.
  3. Go to a Lok Seva Kendra, MP Online kiosk, CSC or the tehsil office for the tehsil where the deceased last lived, and file the heirship application on the prescribed form.
  4. Attach the death certificate, the affidavit, your identity proof, the family's Samagra ID, relationship proof for every heir listed, and the khasra and khatauni extracts if land is involved.
  5. Pay the counter fee and take the dated receipt with the application number. Do not leave the counter without it. You cannot track or appeal without that number.
  6. Attend the Patwari's enquiry. The Patwari visits the village or ward, checks the Samagra and ration entries, and may record neighbours' statements. Keep every original ready.
  7. Where land is involved, file the connected undisputed namantaran case on RCMS at rcms.mp.gov.in, which the Lok Seva service list carries as an RCMS service, and track the case number there.
  8. Collect the signed order or certificate from the tehsil office or the Lok Seva Kendra once the Tehsildar has approved it.

How do you check the status of your application?

Track the heirship application at the Lok Seva Kendra using the receipt number from the counter, and follow the connected mutation case on rcms.mp.gov.in using the RCMS case number, where hearing dates and orders are published. If the Patwari has visited and nothing has moved, take the printed receipt to the Tehsildar's reader and ask for the file's current position in writing. Keeping the paper trail is what makes the statutory appeal usable later.

How long is the certificate valid?

A Madhya Pradesh legal heir record has no expiry date and needs no renewal. The death and the identity of the survivors are settled facts. Institutions that ask for a "recent" copy are asking for a fresh certified copy, not a fresh enquiry; obtain a certified copy from the tehsil record room. A fresh application only becomes necessary when the recorded family composition must change, for example when a child born after the death has to be added, or when an heir omitted in error must be included.

Why do heirship applications get rejected in Madhya Pradesh?

  • An heir was omitted. Married daughters and children from an earlier marriage are the ones most often left out, and their omission is fatal.
  • Samagra and application mismatch. If the family's Samagra record does not show the person named, the Patwari raises a query.
  • Name spelt differently on the death certificate, Aadhaar and the land record. Fix the mismatch first.
  • Wrong jurisdiction; filed in a tehsil where the deceased did not last reside and holds no land.
  • No notarised affidavit, or one that does not name every heir.
  • An objection filed by another claimant, which turns the file into a disputed case requiring a full hearing.
  • Nobody available for the Patwari's visit across repeated attempts.

What does it cost, and should you use an agent?

File the application directly at a Lok Seva Kendra, MP Online kiosk or CSC and pay only the fee printed on the counter receipt, and file the connected mutation yourself on RCMS, which is free to view and track. The genuinely unavoidable outside costs are the stamp paper and notarisation for the affidavit, and: only if a bank insists on the court route, the ad valorem court fee and an advocate's fee for a succession certificate. Middlemen who promise a Waris certificate "in a week" cannot shorten the Patwari's enquiry, which is the step that actually sets the timeline. Never pay cash without a receipt, and never hand over original documents to an intermediary.

Where do you complain if the certificate is delayed?

Madhya Pradesh's Public Services Guarantee Act, 2010 provides an appeal to a designated first appellate officer, and then a second appeal, when a notified service is not delivered within its published time limit: check the entry and time limit for your service on the Lok Seva service list at mpedistrict.gov.in before appealing. Outside that route, escalate in order to the Tehsildar, the Sub-Divisional Officer (Revenue) and the District Collector, all of whom hold public grievance hearings; the Collector's office in every district also runs the Jansunwai grievance day. Quote the counter receipt number and the RCMS case number in every letter.

A note on what could not be verified

The exact rupee fee and the notified time limit for the heirship application vary by district and by the current Lok Seva notification, and Madhya Pradesh revises its notified service list periodically. Confirm the fee and the time limit on the service page at mpedistrict.gov.in or at the Lok Seva Kendra counter before you pay, and always take the printed receipt.

Frequently asked questions

What is a legal heir certificate called in Madhya Pradesh?

A legal heir certificate in Madhya Pradesh is called the Waris Praman Patra or Uttaradhikar Praman Patra, and it is recorded by the Tehsildar of the tehsil where the deceased last lived. Applications are accepted at Lok Seva Kendras, MP Online kiosks and CSCs.

Who issues a legal heir certificate in Madhya Pradesh?

The Tehsildar, acting as a revenue officer for the tehsil, issues the legal heir record in Madhya Pradesh after the Patwari and Revenue Inspector verify the family. No municipal or registration office issues this document.

What is RCMS and how is it connected to heirship?

RCMS is the Madhya Pradesh Revenue Case Management System at rcms.mp.gov.in, the online system through which revenue cases including undisputed namantaran: the mutation that replaces a deceased owner's name with the heirs' names in the khasra and khatauni, are filed and tracked. The Lok Seva service list carries undisputed namantaran as an RCMS service.

What is the difference between a Waris certificate and a succession certificate?

A Waris certificate is an administrative record of who the heirs are, made by the Tehsildar, while a succession certificate is a civil court order under the Indian Succession Act, 1925 authorising an heir to collect debts and securities. Banks holding large fixed deposits and companies holding shares generally insist on the court-issued succession certificate.

Does the Madhya Pradesh Lok Seva Guarantee Act cover this service?

The Madhya Pradesh Public Services Guarantee Act, 2010 makes notified services deliverable within a fixed time limit, with an appeal if the deadline is missed, and the state publishes the notified services and their time limits on the Lok Seva portal at mpedistrict.gov.in. Check the service list for the current entry and time limit before filing an appeal, because the notified list is revised from time to time.

Does a Madhya Pradesh legal heir certificate expire?

A legal heir certificate does not expire, because it records permanent facts about a death and the surviving family. Institutions that ask for a recent copy want a fresh printout, not a fresh application.

Can I apply for a legal heir certificate in Madhya Pradesh online?

Madhya Pradesh routes citizen applications through Lok Seva Kendras, MP Online kiosks and CSCs, and the connected mutation case is filed and tracked online on RCMS. Confirm at your tehsil whether the heirship application itself is accepted directly online in your district, because the counter route is the one available everywhere.

Do all heirs need to sign the application?

One heir applies, but the affidavit must name every surviving heir and the Patwari's enquiry will try to contact them. Leaving out a married daughter or a child from an earlier marriage is the commonest reason a Madhya Pradesh heirship file is rejected or later challenged.
