What was the VAT exemption for manufacturing MSMEs in Mizoram?

VAT Exemption for Manufacturing MSMEs is the tax incentive set out at clause 5.2 of the Mizoram Industrial Policy 2012, jointly touching the Commerce & Industries Department, which runs the District Industries Centres, and the Taxation Department, which administers the Mizoram VAT Act.

The 2012 policy states that all the materials used as raw material by, and manufactured by, manufacturing micro and small enterprises would be exempted from VAT for a period of 7 years from the date of commercial production in general and 10 years for thrust sector enterprises.

The exemption was the largest single incentive in the 2012 package. Where the nine cash subsidy heads reimbursed specific costs with ceilings measured in thousands of rupees, this one removed a tax on both sides of the ledger; inputs bought and output sold, for most of a unit's formative decade.

Note the scope precisely: clause 5.2 covers micro and small enterprises, not medium ones, despite the head being widely referred to as an MSME exemption. Clause 5.2.1 dealt with medium and large enterprises separately and only in aspirational terms, saying that "efforts will be made by the government to put in place a scheme of VAT remission for Medium and Large Enterprises" in order to rationalise pricing for consumers in the state.

Who could claim the VAT exemption, and who could not?

You could claim if:

  • The enterprise was a manufacturing micro or small enterprise in Mizoram.
  • The unit was registered under the Mizoram VAT Act.
  • The raw materials procured and the goods manufactured were those listed in the Entrepreneur Memorandum Part-II and accepted by the District Industries Centre.
  • The unit invariably filed returns on purchase of raw material and on production, at both the DIC and the Taxation Department.
  • The claim fell within 7 years of commercial production, or 10 years for a thrust sector unit.

You were not eligible if:

  • The enterprise was a medium or large unit. Those units cannot apply under clause 5.2; only the separate remission intent at clause 5.2.1 mentioned them.
  • The business was a trading or reselling operation rather than a manufacturing one.
  • The unit was not registered under the Mizoram VAT Act.
  • The goods dealt in were outside the EM Part-II list accepted by the DIC, in which case the exemption did not extend to them.
  • The unit failed to file the required returns at either office; the policy makes filing an express condition rather than a formality.

Which thrust sectors got the longer 10-year exemption?

The Mizoram Industrial Policy 2012 identified ten thrust sectors, chosen for value addition on locally available resources:

  • Forest-based industries, particularly bamboo
  • Food processing industries
  • Handloom industries
  • Handicraft industries
  • Plantain fibre and hill brooms
  • Tea, rubber, coffee and plantation-based industries
  • Textile-related industries
  • Animal feed and poultry feed industries
  • Entertainment and music industries
  • Packaging industries

The policy also left room for "any other Industry to be notified by the Government in this regards from time to time." A unit in any of these sectors received the exemption for 10 years rather than 7.

What documents and compliances were required?

Document Mandatory Notes
EM Part-II, now Udyam Registration Yes Fixes the list of raw materials and goods covered
Mizoram VAT Act registration Yes Express condition of the exemption
Returns on raw material purchase and production Yes To be filed at both the DIC and the Taxation Department
Proof of date of commercial production Yes Starts the 7-year or 10-year clock
Evidence of thrust sector activity For 10-year period To establish the longer entitlement
GST registration In practice Relevant today, since GST replaced VAT on most goods

How to apply for the exemption, and what to do instead today

  1. Check what tax actually applies to your goods. GST replaced VAT on most goods across India from 1 July 2017. State VAT now survives only for a narrow set of items such as petroleum products and alcohol, so for most manufacturing MSMEs in Mizoram there is little or no VAT left to be exempted from.
  2. Complete Udyam Registration, free of cost, on the national Udyam portal. Udyam Registration started on 1 July 2020 and replaced both the Udyog Aadhaar Memorandum and the Entrepreneur Memorandum Part-II. It is the document that now performs the role EM Part-II played in the 2012 conditions.
  3. Register for GST and file returns regularly, since the successor incentive works through SGST paid and returns filed.
  4. Approach your District Industries Centre; Aizawl, Lunglei, Siaha, Lawngtlai, Champhai, Serchhip, Mamit, Kolasib, Hnahthial, Khawzawl or Saitual; to confirm which tax incentive your unit can claim today, and to obtain the applicable form. Forms under the 2012 regime were bought from the Directorate of Industries at Rs 50 each.
  5. File the State GST reimbursement claim within 6 months of filing the SGST return for the period, as required by the 2025 policy.

Why claims under this head fail today

  • There is no VAT to exempt. GST subsumed VAT on nearly all manufactured goods from 1 July 2017, which is the fundamental reason this head is now of historical interest.
  • The 7-year or 10-year window has long expired for units that commenced production in the years after 2012.
  • EM Part-II no longer exists, having been replaced by Udyam Registration in 2020, so the document the condition refers to cannot be produced by a new unit.
  • Returns not filed at both offices, which was an express condition and is routinely missed.
  • Unit classified as medium, and therefore outside clause 5.2 in the first place.

What replaced it under the Industrial and Investment Policy of Mizoram 2025?

The Government of Mizoram notified The Industrial and Investment Policy of Mizoram, 2025 on 21 August 2025 vide No.P-19020/6/2025-C&I, published in the Mizoram Gazette Extraordinary Issue No. 597 dated 22 August 2025, with immediate effect. The policy consolidates the Mizoram Sustainable Investment Policy 2024 and the Industrial Policy of Mizoram 2025 into a single framework.

Item 11 of the 2025 incentive table replaces the VAT exemption with State GST Reimbursement:

  • Available to manufacturing micro, small and medium enterprises, a widening from the micro-and-small scope of clause 5.2.
  • Reimbursement is of the net SGST paid, other than the amount of tax paid by utilisation of input tax credit. This is the crucial mechanical difference: a unit is reimbursed only the cash component of its state GST, not tax settled through credit.
  • The period is 5 years from the date of commencement of commercial production, shorter than the old 7-year and 10-year windows, and with no separate thrust sector extension in the table.
  • The claim must be made within 6 months from the date of filing the SGST return, a hard procedural deadline that did not exist under the exemption regime.
  • As with all incentives under clause 8.1, disbursal happens only after commencement of commercial operations.

Alongside this, the 2025 policy adds a procurement advantage that works in the same direction as a tax break. Under the Mizoram Procurement Preference Policy for Micro and Small Enterprises, 2025, the Government of Mizoram reserves a minimum of 25 per cent of its annual procurement for MSEs registered and operating in the state and employing at least 70 per cent local workforce, grants them a price preference of up to 12 per cent over the lowest out-of-state bid, and exempts them from tender fees and Earnest Money Deposits.

  • 1 July 2017, GST came into force across India, subsuming VAT on most goods and effectively hollowing out this head.
  • 1 July 2020, Udyam Registration replaced the Entrepreneur Memorandum Part-II, the document named in the exemption's own conditions.
  • 21 August 2025, Industrial and Investment Policy of Mizoram 2025 notified, substituting a 5-year State GST reimbursement with a 6-month claim deadline.

Documents required

Entrepreneur Memorandum Part-II, now Udyam Registration
The 2012 policy requires that the raw materials procured and goods manufactured be those listed in the EM Part-II accepted by the District Industries Centre. Udyam Registration replaced EM Part-II from 1 July 2020.
Registration under the Mizoram VAT Act
The policy makes VAT registration an express condition of the exemption.
Returns on purchase of raw material and production
The unit must invariably file these returns at both the District Industries Centre and the Taxation Department.
Proof of date of commercial production
The 7-year or 10-year exemption period runs from the date of commercial production.
Evidence of thrust sector activityoptional
Needed only to claim the longer 10-year period, by showing the unit falls in one of the ten thrust sectors listed in the 2012 policy.
GST registrationoptional
Not part of the 2012 condition, but now the relevant registration in practice, since GST replaced VAT on most goods from 1 July 2017 and the 2025 policy works through State GST reimbursement.

Frequently asked questions

How long did the VAT exemption last for a Mizoram manufacturing unit?

The exemption ran for 7 years from the date of commercial production in general, and 10 years for enterprises in the thrust sectors identified by the Mizoram Industrial Policy 2012.

Who was eligible for the VAT exemption?

Manufacturing micro and small enterprises were eligible under clause 5.2 of the 2012 policy. Medium and large enterprises were not covered by the exemption; the policy said only that efforts would be made to put in place a separate VAT remission scheme for them.

Is the VAT exemption still usable today?

In practice, largely not. GST replaced VAT on most goods across India from 1 July 2017, leaving state VAT applicable only to a narrow set of items such as petroleum products and alcohol, so there is little VAT left for a manufacturing MSME to be exempted from.

What replaced it under the 2025 policy?

The Industrial and Investment Policy of Mizoram 2025 provides State GST Reimbursement for manufacturing micro, small and medium enterprises on the net SGST paid, other than tax paid by utilising input tax credit, for 5 years from the date of commencement of commercial production. The claim must be made within 6 months of filing the SGST return.

What were the conditions attached to the exemption?

Three conditions were listed: the raw materials procured and goods manufactured had to be those listed in the Entrepreneur Memorandum Part-II accepted by the District Industries Centre, the unit had to be registered under the Mizoram VAT Act, and the unit had to invariably file returns on purchase of raw material and on production at both the DIC and the Taxation Department.

Which sectors counted as thrust sectors for the 10-year period?

The 2012 policy identified forest-based industries, food processing, handloom, handicraft, plantain fibre and hill brooms, tea, rubber, coffee and plantation-based industries, textile-related industries, animal and poultry feed industries, entertainment and music industries, and packaging industries, plus any other industry the Government may notify.

Does the Entrepreneur Memorandum still exist?

No. Udyam Registration started on 1 July 2020 and replaced both the Udyog Aadhaar Memorandum and the Entrepreneur Memorandum Part-II as the sole online MSME registration process in India, so a unit today holds a Udyam certificate rather than an EM Part-II.
