Legal Heir / Succession Certificate in Rajasthan

Rajasthan state government scheme
Legal Heir Certificate in Rajasthan is issued by the Tehsildar of the tehsil where the deceased ordinarily lived, on an application filed at the tehsil office or through an e-Mitra kiosk. Rajasthan does not list it as a standalone online certificate on e-Mitra the way it lists caste, income and domicile. Inherited land is transferred by namantaran on apnakhata.rajasthan.gov.in, where the Board of Revenue states all record copies are free.
Legal Heir Certificate in Rajasthan is the Revenue Department's written record of who the surviving heirs of a deceased person are, signed by the Tehsildar or Naib Tehsildar of the tehsil where the deceased ordinarily lived. Rajasthan handles this differently from its other citizen certificates. Caste, income, domicile and EWS certificates all run as online e-Mitra services through the SSO Rajasthan login at sso.rajasthan.gov.in, but the heirship certificate is not published on that certificate list, so the application is made at the tehsil office and an e-Mitra kiosk assists rather than issues.
What is a legal heir certificate in Rajasthan and who issues it?
A legal heir certificate names the surviving heirs of a deceased person and states each heir's relationship to them. Rajasthan departments use it to release family pension, gratuity, provident fund balances, leave encashment and group insurance dues, to process a compassionate appointment file, and as supporting evidence when inherited khatedari land is mutated in the jamabandi.
The Rajasthan Revenue Department issues it through the tehsil establishment. The Patwari of the halka carries out the field enquiry, the Girdawar counter-checks the declared heir list against the recorded household, and the Tehsildar or Naib Tehsildar signs. Because the enquiry is local, jurisdiction is decided by where the deceased ordinarily resided, not by where the surviving heirs now live. A family that moved from Barmer to Jaipur after the death still files in the Barmer tehsil.
Above the tehsil sits the Board of Revenue at Ajmer, the apex revenue authority for Rajasthan, which runs the state's land records through the Apna Khata (e-Dharti) portal at apnakhata.rajasthan.gov.in and publishes 0145-2627891 as its contact number.
What is the difference between a legal heir certificate and a succession certificate?
This distinction decides which office you walk into, and getting it wrong costs a Rajasthan family weeks.
A legal heir certificate is an administrative document. It is inexpensive, it comes from the Tehsildar, and it is enough for state government dues, employer settlements, pension branches, small bank balances and the revenue record.
A succession certificate is a judicial order under Sections 370 to 390 of the Indian Succession Act 1925, granted by the District Judge having jurisdiction. It authorises the holder to collect the debts and securities of the deceased, which in practice means bank deposits, fixed deposits, shares, debentures, bonds and mutual fund units. It costs far more, because the court fee is charged ad valorem as a percentage of the value of the assets listed, and it takes months rather than weeks because the court must publish a citation inviting objections before granting it.
One limit matters and is widely misunderstood in Rajasthan. A succession certificate covers movable assets and debts. It does not transfer immovable property. Agricultural khatedari land, a house or a plot passes by inheritance namantaran in the revenue record, and where the title itself is disputed, by a civil suit for declaration or partition.
The practical rule is this. For a pension file, a PF claim or a namantaran, get the legal heir certificate from the Tehsildar. For a bank refusing to release a large deposit or a demat account, expect to be sent to the District Judge.
Who can and cannot apply in Rajasthan?
Any surviving heir of the deceased can apply. Under the Hindu Succession Act 1956 that means the spouse, sons, daughters and mother as Class I heirs, with the applicable personal law deciding the position for Muslim, Christian and Parsi families in Rajasthan. A minor heir applies through a natural guardian. Where several heirs exist, one heir applies and names all the others, and every one of them appears on the certificate.
You cannot apply if you are not an heir under the personal law that governs the family. A cousin, a neighbour, a tenant on the land, a business partner or a creditor of the deceased is not eligible, however real their interest in the estate. An applicant who cannot show that the deceased ordinarily resided in that tehsil is not eligible in that tehsil and must file where jurisdiction lies. A person who needs authority to collect large bank deposits or securities is not eligible for that purpose through the revenue route at all and must petition the District Judge instead.
Rajasthan applies no income limit, no caste criterion and no separate domicile test to a legal heir certificate. Residence matters only in fixing which Tehsildar hears the file.
What documents are required?
The death certificate is the foundation of the file. Beyond it, carry the applicant heir's Aadhaar, identity proof of the deceased, a residence proof fixing the tehsil, and a notarised affidavit on stamp paper listing every surviving heir with age and relationship. A ration card or family record lets the Patwari cross-check that list. Where one heir applies for all, the Tehsildar will want the other heirs' no-objection.
Add a copy of the current jamabandi of the deceased's khatedari land where the purpose is namantaran, which can be downloaded free from Apna Khata, and the deceased's service or pension records where the claim is against an employer.
How to get a legal heir certificate in Rajasthan
- Register the death and collect the death certificate from the Nagar Nigam, Nagar Palika or Gram Panchayat where the death occurred. Take five or six attested copies, because every later office keeps one.
- Prepare the heir affidavit. Draft it on stamp paper naming every surviving heir with age and relationship, get it notarised, and collect written no-objection from any heir who is not applying jointly.
- Assemble the identity and residence proofs, the applicant's Aadhaar, the deceased's identity proof, and a ration card, voter roll entry or electricity bill establishing the tehsil of ordinary residence.
- Go to the tehsil office of the tehsil where the deceased ordinarily lived and ask the Tehsildar's reader for the heirship application form. An e-Mitra kiosk can prepare and print the set for the notified kiosk charge if you would rather not fill it yourself.
- Submit the file and take the receipt with the diary number written on it. That number is the only thing that lets you chase the file later.
- Wait for the Patwari's field verification. The Patwari visits the village or ward, confirms the heir list locally and reports to the Girdawar, who puts it up to the Tehsildar.
- Follow up at the tehsil with the diary number, and once the Tehsildar signs, collect the certificate at the counter. Photocopy and attest it before handing the original to any bank or department.
How do I get inherited land mutated in Rajasthan?
Rajasthan runs its land records on the Apna Khata (e-Dharti) portal at apnakhata.rajasthan.gov.in, operated by the Board of Revenue. The portal carries jamabandi copies, an online namantaran (mutation) application, seemagyan boundary demarcation requests and division consent applications, and it states that all copies on the portal are available free of cost.
For an inheritance namantaran, apply on Apna Khata or at the tehsil with the death certificate, the legal heir certificate or affidavit of heirs, and the current jamabandi of the khata concerned. The Patwari records the case, notice is given so that co-sharers can object, and the Tehsildar sanctions the entry once the objection period closes. If a co-sharer objects, the file becomes a contested revenue case and is heard rather than passed over the counter.
Read the portal's own disclaimer before relying on a download: Apna Khata says the online record is for general information only, and a certified copy usable in court must be obtained through a designated e-Mitra kiosk at the notified rate.
How do I get a succession certificate from the District Court?
- Engage a lawyer and file a petition before the District Judge of the district where the deceased ordinarily resided or where the assets are held, setting out the death, the relationship, the full list of heirs and a schedule of the debts and securities claimed.
- Attach the death certificate, proof of relationship, and documentary proof of every asset: the bank passbook, the fixed deposit receipt, the demat statement or the share certificate.
- Pay the ad valorem court fee, calculated as a percentage of the value of the assets listed under the court-fee schedule applicable in Rajasthan. Ask the court's copying agency or your counsel for the exact figure for your value slab before filing, because it is the largest single cost in the whole process.
- Wait for the citation. The court publishes a notice inviting objections from anyone claiming an interest. If nobody objects within the period allowed, the certificate is granted; if an objection is filed, the matter is heard on evidence.
- Collect the certified copy and lodge it with the bank, company or depository holding the asset. District court case status in Rajasthan can be tracked through the eCourts services using the case number issued at filing.
Why do heirship files stall in Rajasthan?
- An incomplete heir list. Leaving out a married daughter, the children of a predeceased son or a second wife's children is the single commonest defect, and it surfaces only when the omitted heir objects.
- Wrong jurisdiction. Filing in the tehsil where the heirs now live rather than where the deceased ordinarily resided.
- Name mismatch. The spelling on the death certificate not matching the Aadhaar, ration card or jamabandi entry of the deceased.
- An unnotarised or unsworn affidavit, or one that does not state each heir's age and relationship.
- No residence proof tying the deceased to that tehsil.
- A dispute among the heirs themselves, at which point the Tehsildar declines to certify and the family is left to the civil court.
- Asking the revenue route to do a court's job, seeking authority over large bank deposits or securities from the Tehsildar rather than from the District Judge.
What does it cost, and where do I complain?
Pay only the government's own charges. In Rajasthan those are the stamp paper and notary fee for the heir affidavit, the court fee stamp on the application, the notified e-Mitra kiosk rate if a kiosk files for you, and the mutation charge for the namantaran. Jamabandi copies on Apna Khata are free, as the portal states in its own words. There is no large separate fee for a legal heir certificate, and nobody in the tehsil is entitled to anything beyond the listed amounts.
Agents sitting outside tehsil offices in Jaipur, Jodhpur, Kota and Udaipur routinely quote a few thousand rupees to "get it passed". That is money for a file any heir can submit personally, and paying it does not move the file ahead of anyone else's.
For delay or overcharging, take the diary number and the receipt to the Sub Divisional Officer, and then to the District Collector, who heads revenue administration in the district. For land record and namantaran problems, the Board of Revenue at Ajmer publishes 0145-2627891 on the Apna Khata portal. Keep the affidavit copy and the receipt: every escalation asks for both.

Frequently asked questions
Can I apply for a legal heir certificate online on e-Mitra in Rajasthan?
No, Rajasthan does not publish a standalone legal heir certificate as an online e-Mitra certificate service the way it publishes caste, income, domicile (bonafide) and EWS certificates. The heirship application is made at the tehsil office of the tehsil where the deceased ordinarily resided, and an e-Mitra kiosk can help you prepare and submit the papers rather than issue the certificate itself.
What is the difference between a legal heir certificate and a succession certificate in Rajasthan?
A legal heir certificate is a Revenue Department document signed by the Tehsildar that simply names the surviving heirs, while a succession certificate is a judicial order granted by the District Judge under the Indian Succession Act 1925. Rajasthan government departments, pension branches and the revenue record accept the first; banks holding large deposits, companies holding shares and depositories holding demat accounts generally insist on the second.
Who issues the legal heir certificate in Rajasthan?
The Tehsildar or Naib Tehsildar of the tehsil where the deceased ordinarily lived issues it, after the Patwari of the halka reports on the heir list and the Girdawar counter-checks it. It is a revenue document, not a court order, and it is signed in the tehsil office rather than in any court.
How do I get inherited land transferred to my name in Rajasthan?
Apply for namantaran through the Apna Khata (e-Dharti) portal at apnakhata.rajasthan.gov.in, which carries the online namantaran application, jamabandi copies and boundary demarcation requests. The Board of Revenue states on the portal that all record copies are available free of cost, and the Tehsildar sanctions the inheritance namantaran after the objection period passes.
Is the jamabandi copy from Apna Khata free in Rajasthan?
Yes, apnakhata.rajasthan.gov.in states plainly that all copies on the portal are available free of cost. The portal also warns that an online copy is for general information only and that a certified, legally usable copy must be obtained through a designated e-Mitra kiosk, which charges the notified kiosk rate.
Do I need a succession certificate for a bank account in Rajasthan?
Usually yes, once the balance crosses the bank's own threshold for settlement without one. Rajasthan banks routinely settle small balances against a legal heir certificate, an indemnity bond and a no-objection from the other heirs, but for large fixed deposits, shares, debentures and mutual fund units they ask for a succession certificate from the District Judge.
Does a Rajasthan legal heir certificate expire?
No, a legal heir certificate has no expiry date, because it records a fact about a family that does not change with time. A fresh certificate is needed only when an heir was left out, a name or age is wrong, or another heir has since died and the list has to be restated.
How much should I pay an agent for a legal heir certificate in Rajasthan?
Nothing beyond the government's own charges, which are the stamp paper and notary fee for the affidavit, the court fee stamp on the application and the notified e-Mitra kiosk rate if you file through a kiosk. Agents outside Rajasthan tehsil offices routinely quote several thousand rupees for a file any heir can submit personally.
