Legal Heir / Succession Certificate in Tripura
Tripura state government scheme
Legal Heir Certificate in Tripura is issued by the Sub-Divisional Magistrate's office of the Revenue Department after a Tehsildar enquiry. Tripura's e-District portal at edistrict.tripura.gov.in lists a Dependent Certificate and a Survival Certificate but no legal heir service, so the heirship application is filed by hand. A succession certificate for bank deposits and securities comes only from the District and Sessions Judge.
What is a legal heir certificate in Tripura?
A legal heir certificate in Tripura is a Revenue Department document that names every surviving heir of a deceased person with their age and relationship. Tripura issues it through the Sub-Divisional Magistrate of the sub-division in which the deceased last lived, on the strength of a field enquiry by the Tehsildar of the concerned tehsil.
Tripura runs one of the more developed e-District deployments in the North East. The portal at edistrict.tripura.gov.in, backed by the Revenue Department, delivers Permanent Resident of Tripura Certificate, Marriage Certificate, Income Certificate, Survival Certificate, Land Valuation Certificate, Distance Certificate, SC, ST and OBC certificates, Character Certificate with antecedent report, and Dependent Certificate. Each service page publishes the issuing line department, the submission modes: by hand, online or through a kiosk, the document list and the service delivery time; the Income Certificate page, for instance, shows the Revenue Department as the line department and 15 days excluding government holidays as the delivery period.
The legal heir certificate is not among those services. That is the practical fact that decides how you approach it: there is no online form, no e-District application number and no portal-published timeline for heirship in Tripura. You file it at the SDM's office by hand.
The second route is the succession certificate, and it is a court document rather than a departmental one. Sections 370 to 390 of the Indian Succession Act 1925 empower the District Judge to certify who may collect debts due to the deceased and deal with securities standing in the deceased's name. In Tripura that jurisdiction lies with the District and Sessions Judge of the district.
Which certificate does the office in front of you actually want?
The legal heir certificate from the SDM is the right paper for claims against government and semi-government offices:
- Family pension, commuted pension and pension arrears of a deceased Tripura government employee.
- General Provident Fund, gratuity and group insurance dues.
- Compassionate appointment of a dependent.
- Arrears of pay and leave encashment.
- Ration card head-of-family change, gas connection and electricity meter transfer.
- Small bank balances released on an heirship declaration within the bank's internal limit.
The succession certificate from the District and Sessions Judge is the right paper when the asset holder needs court protection:
- Fixed deposits and savings balances above the bank's internal threshold.
- Shares, debentures and mutual fund units where no nomination exists.
- Insurance proceeds with no registered nominee.
- Debts owed to the deceased by third parties.
Neither certificate settles ownership of land or a house. Tripura land disputes between branches of a family go to the civil court as a partition or declaration suit, and mutation of the deceased's holding follows the Revenue Department's own mutation process once the heirship position is clear.
Who can and who cannot apply?
You can apply for a legal heir certificate in Tripura if you are a surviving next of kin of a person who died while ordinarily resident in the state:
- The widow or widower of the deceased.
- Sons and daughters, including lawfully adopted children.
- The mother, and the father where the applicable personal law makes him an heir.
- Children of a predeceased son or daughter, who take their parent's share.
- The natural or court-appointed guardian of a minor heir.
You cannot apply in Tripura for a person who neither died in nor ordinarily resided in the state. The SDM's jurisdiction is territorial and stops at the sub-division boundary. You are also not eligible if you are a creditor, a business partner, a landlord or an employer with money at stake but no relationship of heirship; those claims belong in a civil suit. A Tripura SDM will further decline the application where a registered will has been produced, because a will replaces intestate succession and the executor's remedy is probate or letters of administration from the District Judge.
Tripura applies no income ceiling, no caste condition and no property threshold to a legal heir certificate. The Permanent Resident of Tripura Certificate is asked for as proof that the deceased belonged to the sub-division, not as an eligibility test on the applicant.
What documents are required?
Tripura Revenue Department counters work from a Common Application Form plus:
- Death certificate of the deceased from the Gram Panchayat, Nagar Panchayat or Municipal Corporation registrar.
- Affidavit of heirship on stamp paper, sworn before a notary or Executive Magistrate, listing every heir and stating that none has been omitted.
- Permanent Residence of Tripura Certificate or citizenship certificate, the residence proof Tripura's Revenue services rely on across the board.
- Family ration card, which Tripura Revenue services list as a standard supporting document and which shows household composition.
- Photo identity proof of the applicant; Aadhaar, PAN, passport or voter ID.
- Proof of relationship for each heir, birth certificates, school certificates, or a registered marriage certificate for a spouse.
- Service, pension or GPF papers of the deceased where the claim is a pensionary one.
- Passport-size photographs as the counter requires.
Take originals for verification and one photocopy set of each. Tripura e-District document lists are explicit that supporting papers are photocopies while the application form itself is submitted in original, and the SDM counter follows the same convention for heirship.
How to apply for a legal heir certificate in Tripura
- Register the death and collect the death certificate. Order four or five certified copies at the registrar's counter in one go. The bank, insurer, pension office and SDM file each retain one, and returning for extra copies wastes weeks.
- Draw up the affidavit of heirship. List each surviving heir with full name, age, relationship and address on stamp paper and swear it before a notary or Executive Magistrate. Omitting an heir is the single commonest reason a Tripura heirship certificate is later challenged and cancelled.
- Collect the application form at the Sub-Divisional Magistrate's office of the sub-division where the deceased last lived, and fill it in with the deceased's name, date of death, last address and the full list of heirs.
- Submit the form with all supporting papers — death certificate, affidavit, PRTC, family ration card, relationship proofs and your own photo ID, and keep the receipt with the diary number.
- Pay only the counter fee and take a receipt. Tripura publishes no fee for this service, so the receipt is your only protection.
- Assist the Tehsildar's field enquiry. The Tehsildar verifies the family composition locally, may record statements from neighbours or the Panchayat, and the office typically allows an objection window for any omitted heir to come forward.
- Collect the certificate from the SDM's office after the enquiry report is accepted, and ask for the extra attested copies you need in the same visit.
How to get a succession certificate in Tripura
- File a petition under Section 372 of the Indian Succession Act 1925 before the District and Sessions Judge having jurisdiction over the deceased's ordinary residence or over the property.
- Annex the schedule of debts and securities claimed; account numbers with balances, fixed deposit receipts, share certificates and folio numbers, together with the death certificate and relationship proofs.
- Pay the ad valorem court fee on the value of the debts and securities claimed, plus process and copying charges.
- Wait out the public notice period, usually 45 days, during which any objector may come forward. An objection converts the petition into contested litigation.
- Furnish security if the court directs it, and collect the certified copy for the bank, company or depository.
How do you check the status of your application?
There is no online tracker for the Tripura legal heir certificate, because it is not an e-District service. Follow the file by the diary number on your receipt with the SDM's dealing assistant. The Tripura e-District portal does publish contact details for the platform and district-level officials. The portal's listed system engineer contact is 0381-2355751, and the Citizen Section of the portal carries district level contact details for the Revenue Department. Use those for portal or department contact information; use the SDM's grievance counter for the heirship file itself.
For the court route, track the matter by case number in the District and Sessions Judge's registry.
Why are legal heir applications rejected in Tripura?
- An heir was left out of the affidavit and a rival claimant objected during the Tehsildar's enquiry.
- The deceased left a registered will, making probate or letters of administration the correct remedy.
- The application was filed in a sub-division with no territorial connection to the deceased's last residence.
- The PRTC, ration card or relationship documents did not match one another on names or spellings.
- The death certificate was missing or carried a name that differed from the identity documents.
- The real dispute is over ownership of immovable property, which the SDM has no power to decide.
- A civil suit or police case over the same estate is pending, and the office kept the file in abeyance.
What does it cost, and what about agents?
Tripura issues the legal heir certificate at the government's counter fee only, plus the genuine cost of stamp paper and notarisation for the affidavit. Because the state does not publish a rate for it on edistrict.tripura.gov.in the way it publishes service details for the Income Certificate and the other listed services, take a written receipt for every rupee you hand over. Nobody at the SDM or Tehsildar office is entitled to anything beyond the counter figure.
Agents outside sub-divisional offices in Agartala, Udaipur, Dharmanagar and Kailashahar routinely quote several thousand rupees for a "quick" heirship certificate. They cannot compress the Tehsildar's field enquiry, they cannot remove the objection window, and a certificate obtained on a defective affidavit falls apart the moment another heir contests it. File it yourself, keep the affidavit truthful and complete, and report any demand for extra money to the Sub-Divisional Magistrate or the District Magistrate's grievance cell.

Frequently asked questions
Can I apply for a legal heir certificate online in Tripura?
No, the Tripura e-District portal at edistrict.tripura.gov.in does not list a legal heir or succession certificate. The certificate services it does carry include the Permanent Resident of Tripura Certificate, Marriage Certificate, Income Certificate, Survival Certificate, Land Valuation Certificate, Distance Certificate, SC, ST and OBC certificates, Character Certificate with antecedent report, and Dependent Certificate. The heirship application is filed by hand at the Sub-Divisional Magistrate's office.
Who issues a legal heir certificate in Tripura?
The Sub-Divisional Magistrate of the Revenue Department issues the legal heir certificate in Tripura, acting on an enquiry report from the Tehsildar of the tehsil where the deceased last resided. Tripura's Revenue Department is the line department behind all the certificate services delivered on the e-District platform, and heirship follows the same departmental chain even though it is filed offline.
How is a Dependent Certificate different from a legal heir certificate in Tripura?
A Dependent Certificate, which Tripura does issue through e-District, certifies that a named person was financially dependent on the deceased, while a legal heir certificate lists every person who inherits. Tripura departments processing a compassionate appointment often ask for the Dependent Certificate, whereas a bank or a pension office asks for heirship. Confirm which one the office wants in writing before you apply.
What is a Survival Certificate used for in Tripura?
A Survival Certificate, listed on the Tripura e-District portal, confirms that a pensioner or beneficiary is alive on a given date, and it is unrelated to inheritance. Families sometimes apply for it by mistake when they need a legal heir certificate, and the two are issued for opposite situations.
How long does a Revenue Department certificate take in Tripura?
The Tripura e-District portal publishes a service delivery time against each service — the Revenue Department's Income Certificate, for example, is shown at 15 days excluding government holidays. Tripura does not publish a comparable notified timeline for the legal heir certificate, because the service is not on the portal; the SDM office quotes its own timeline, which depends on how long the Tehsildar's field enquiry and objection period take.
When do I need a succession certificate instead in Tripura?
You need a succession certificate from the District and Sessions Judge when a bank, company or depository holds money or securities of the deceased and wants court protection before releasing them. Sections 370 to 390 of the Indian Succession Act 1925 govern it, the petition is filed under Section 372, and the court charges ad valorem fee on the value of the debts and securities claimed.
What does a legal heir certificate cost in Tripura?
Tripura does not publish a fee for the legal heir certificate, because it is not a listed e-District service, so you pay whatever the SDM or Tehsildar counter quotes plus the genuine cost of stamp paper and notarisation for the affidavit. Ask for a receipt for every payment and refuse any demand beyond the counter figure.
Does a Tripura legal heir certificate expire?
A legal heir certificate in Tripura carries no expiry date, because it records a fixed set of facts about who survived the deceased. Banks and pension offices nonetheless often ask for a copy issued within the previous six months, which the SDM office supplies as a fresh attested copy from the same file.
