What is the UP startup patent reimbursement?

Uttar Pradesh Startup Patent Cost Reimbursement is an intellectual property support head under the Uttar Pradesh Startup Policy 2020, administered by the Department of IT and Electronics through the StartinUP platform. It repays what a startup has spent obtaining a patent; up to Rs 2 lakh for Indian patents and up to Rs 10 lakh for international patents.

According to the StartinUP FAQ, the support only covers successfully awarded patents of incubated startups. That single sentence carries two hard conditions that decide most claims: the patent must be granted, not merely filed, and the startup must be attached to a StartinUP-recognised incubator.

The reason the head exists is straightforward. A single Indian patent taken through drafting, filing, examination response and grant routinely costs a small company a six-figure sum in professional fees alone, and an international filing through the PCT route with national-phase entries in even two or three jurisdictions runs into several lakhs. For a startup with an MVP and no revenue, that cost is often the reason a genuinely novel invention is never protected. Reimbursement after grant removes the sunk-cost risk without asking the state to fund speculative filings.

Founders in Uttar Pradesh generally know the programme by its portal brand, StartinUP. The portal is published and managed by Uttar Pradesh Electronics Corporation Limited (UPLC), and recorded 3,644 recognised startups at the time of checking.

Who is eligible for patent cost reimbursement?

You can claim reimbursement if:

  • Your entity is incorporated or registered in India within the last 10 years as a private limited company, a registered partnership firm or an LLP.
  • Annual turnover has never exceeded Rs 100 crore in any financial year since incorporation.
  • The entity works towards innovation, development or improvement of products, processes or services, or runs a scalable business model with high potential for employment generation or wealth creation.
  • You hold both a DPIIT recognition certificate and a StartinUP recognition certificate.
  • You are incubated with a StartinUP-recognised incubator.
  • The patent has been granted, and the grant certificate names your startup entity as the applicant or assignee.
  • You can produce receipts for the fees actually paid.

You are not eligible, and cannot apply, if:

  • The patent application is still pending, published or under examination. Only awarded patents qualify.
  • You are not incubated with a recognised incubator.
  • The entity is older than 10 years or has crossed Rs 100 crore turnover in any financial year.
  • You operate as a sole proprietorship or an unregistered venture.
  • The business was formed by splitting up or reconstructing an existing business.
  • You are an individual inventor holding the patent in your personal name with no registered startup entity behind it.
  • You are seeking reimbursement for a trademark, copyright or design registration. This head is described as patent support. Note that the separate Uttar Pradesh Electronics Component Manufacturing Policy carries its own patent cost reimbursement for manufacturing units, and the Uttar Pradesh Food Processing Industry Policy 2017 reimburses 75 percent of patent or design registration fees up to Rs 1.50 lakh for food processing units; different policies, different departments, different claims.

How to apply for UP startup patent reimbursement

  1. Register on StartinUP and get DPIIT recognition. Obtain DPIIT recognition on the Startup India portal, then register at startinup.up.gov.in using the Register link and the published Startup Registration Manual. Registration carries no fee, and the certificate is issued within 3 working days; a rejected application may be corrected and resubmitted.
  2. Attach to a recognised incubator. Pick an incubator from the Recognized Incubators list on the portal and obtain an incubation letter. Uttar Pradesh also runs Centres of Excellence, MedTech CoE Lucknow, AIIDE CoE Noida, Drone CoE Kanpur, CoE Blockchain, CoE Telecom 5G/6G at Kanpur and Saharanpur, and CoE Additive Manufacturing, which are natural homes for patent-heavy work.
  3. Prosecute the patent to grant. File with the Indian Patent Office, or internationally through the PCT and the relevant national phases, and keep every fee receipt and professional invoice as you go. Do not file the reimbursement claim before the grant certificate is in hand.
  4. Assemble the claim file. Collect the grant certificate, the complete specification as granted, all fee receipts and attorney invoices, the incorporation certificate, DPIIT and StartinUP certificates, the incubation letter, entity PAN, and bank details with a cancelled cheque. Add a chartered accountant certificate of expenditure if the invoices span multiple financial years.
  5. File the claim online. Log in to startinup.up.gov.in, open the Startup Funding section, choose the patent support head, upload the file and submit. Record the application number.
  6. Answer queries and receive the transfer. Respond to any query from the incubator or the department within the time given. On approval the reimbursement is transferred to the startup's current account, subject to the Rs 2 lakh or Rs 10 lakh ceiling as applicable.

How much is reimbursed?

Patent type Ceiling
Indian patent Rs 2 lakh
International patent Rs 10 lakh

Both figures are ceilings on actual expenditure, not flat grants β€” a startup that spent Rs 1.4 lakh obtaining an Indian patent is reimbursed Rs 1.4 lakh, not Rs 2 lakh. The five-fold difference between the domestic and international ceilings reflects the real cost gap: national-phase entry fees, translation and foreign associate fees dominate an international budget.

There is no published annual last date for filing a claim. Because the trigger is the grant of the patent, which is outside the applicant's control, the head runs on a rolling basis while the policy and its incentive notifications remain in force. The notification on claiming financial incentives under the Uttar Pradesh Startup Policy 2020 is dated 31 August 2020, and the policy itself was approved on 15 July 2020; both documents are downloadable from the Startup Policy 2020 page.

Where does this fit among the other StartinUP incentives?

Patent reimbursement is one of several funding heads on the portal, and startups usually reach it last:

  • Sustenance allowance: Rs 17,500 per month per startup for one year, for up to 25 startups per incubator per year, at idea stage.
  • Prototype development grant: up to Rs 5 lakh, one-time, single payment, for DPIIT and StartinUP registered entities.
  • Seed capital and marketing assistance: up to Rs 7.5 lakh for MVP market launch, in three instalments split 40-30-30, for up to 25 startups per incubator per year.
  • Patent reimbursement: Rs 2 lakh Indian, Rs 10 lakh international, on granted patents of incubated startups.
  • Event participation support, SIDBI Fund of Funds access and the central Startup India Seed Fund Scheme (SISFS).

Startups founded by women, divyangjan or transgender persons, those of EWS origin, and those based in Purvanchal and Bundelkhand, receive an additional 50 percent under the sustenance allowance and seed capital heads. The published FAQ does not extend that enhancement explicitly to the patent head, so do not assume it applies, ask the help desk.

Why do patent reimbursement claims fail?

  • Patent not yet granted. The commonest reason by a wide margin. A filing number, a publication in the Patent Office Journal or a first examination report does not qualify.
  • No incubation linkage. The support is described as being for incubated startups; an unincubated entity has no route in.
  • Patent held in a founder's personal name. The applicant or assignee on the grant should be the startup entity that is claiming.
  • Receipts missing or in another party's name. Invoices addressed to a founder personally, or to a parent company, create a mismatch.
  • Entity outside the startup definition on age, turnover or constitution.
  • Bank account in a personal name rather than the entity's current account.

How do I get help or escalate?

Call the policy help desk on 0522-4130303, extension 302, between 10:00 AM and 6:00 PM on working days. Technical problems with the portal go to 7518980077, and legal and compliance support: often the right desk for an IP question, is on the toll-free 1800-121-1250. Email info@itpolicyup.gov.in or write to 1st Floor, UPLC, Navchetna Kendra, 10 Ashok Marg, Lucknow 226001.

StartinUP runs a dedicated Grievance Redressal section and names a nodal department, nodal agency and nodal officer for escalation. A grievance that is not settled there can be lodged on the Uttar Pradesh Jansunwai portal at jansunwai.up.nic.in, which issues a trackable reference and routes it to the Department of IT and Electronics.

How to check your application status

Because the patent reimbursement claim is filed only after grant, there is no separate approval queue to track before that point; tracking starts once the claim itself is submitted on the portal.

  • Online, through the applicant login. Log in to startinup.up.gov.in with the same credentials used for StartinUP registration, open the Startup Funding section, and pull up the claim using the application number generated at submission. The status field shows whether the claim is still with the incubator for verification, has moved to the Department of IT and Electronics for approval, or has been cleared for payment.
  • Through the incubator. Since the claim is routed through a StartinUP-recognised incubator, the incubator's nodal contact can usually confirm whether they have forwarded the file onward or are still holding it for a query response; this is often faster than waiting on a portal status change.
  • By phone. Call the policy help desk on 0522-4130303, extension 302, between 10:00 AM and 6:00 PM on working days, and quote the application number. For a portal login or upload problem rather than a status question, the technical helpline is 7518980077.
  • By email. Write to info@itpolicyup.gov.in with the application number, entity name, and patent grant reference if you have not had a portal update in a reasonable time.
  • If a query has been raised. A claim commonly shows as pending because the incubator or department has raised a query, most often for a missing receipt, a mismatched applicant name, or an incomplete grant certificate. Check the portal's query or remarks field first before calling, since the fix is usually to re-upload a document rather than to escalate.
  • If there is no update for an extended period. Use the Grievance Redressal section on startinup.up.gov.in, which is routed to a named nodal officer. If that does not resolve it, lodge a complaint on the Uttar Pradesh Jansunwai portal at jansunwai.up.nic.in, which issues a trackable reference number and forwards it to the Department of IT and Electronics.
