Legal Heir / Succession Certificate in Jharkhand

Jharkhand state government scheme

Quick answer

Legal heir proof in Jharkhand is not a listed service on JharSewa, the state e-District portal at jharsewa.jharkhand.gov.in, which carries birth, death, caste, income, residence, EWS and marriage certificates only. Heirship in Jharkhand is settled at the anchal (circle) office of the Revenue, Registration and Land Reforms Department through online mutation on JharBhoomi, while large bank and securities claims need a succession certificate from the District Judge.

Jharkhand does not issue a document called a legal heir certificate, and the sooner a family understands that, the less time it wastes at the wrong counter.

JharSewa, the state's e-District portal at jharsewa.jharkhand.gov.in, publishes its service list openly. It carries the issue of birth certificates, caste certificates, death certificates, income certificates, local resident certificates and income and asset certificates for EWS, along with marriage registration and the old age, disability and widow pension schemes. A legal heir, heirship or succession certificate is not on that list. Anyone claiming it can be downloaded from JharSewa is describing a service the portal does not run.

What Jharkhand does instead is settle heirship at the anchal, the circle office of the Revenue, Registration and Land Reforms Department, where inheritance is recorded through mutation, and the department has taken that process online on the JharBhoomi portal.

What actually proves heirship in Jharkhand?

Three things do the work, and which one you need depends on who is asking for it.

The death certificate is the starting point of every claim. JharSewa lists the issue of death certificates among its e-District services, so it can be applied for online, at a Pragya Kendra, or at the office of the concerned registrar. Nothing else in the chain moves until this exists.

The heir affidavit is the instrument most Jharkhand claims are actually settled on. Sworn on stamp paper and notarised, it names each surviving heir with age and relationship and declares that nobody has been omitted. Employers, pension branches, provident fund offices and banks holding small balances will usually release dues on the death certificate plus this affidavit, supported by a ration card or Aadhaar showing the family together.

The mutated jamabandi is the definitive heirship record where land is involved. Once the Circle Officer passes the inheritance mutation, the revenue record and the rent receipt issue in the heirs' names, and that corrected record is the strongest heirship proof a Jharkhand family can hold.

What is the difference between the anchal route and a succession certificate?

This distinction decides which building you walk into, and getting it wrong costs Jharkhand families months.

The anchal route is administrative. It runs at the circle office, it is inexpensive, it is filed online on JharBhoomi or at the counter, and it settles heirship for state government dues, employer settlements, family pension, provident fund, gratuity, small bank balances and the land record itself.

A succession certificate is judicial. It is granted by the District Judge under Sections 370 to 390 of the Indian Succession Act 1925, it authorises the holder to collect the debts and securities of the deceased, and it costs an ad valorem court fee charged as a percentage of the value of the assets listed. It takes months rather than weeks, because the court must publish a citation inviting objections before it can be granted.

The limit people miss is that a succession certificate covers movable assets and debts only. Bank deposits, fixed deposits, shares, debentures, bonds and mutual fund units fall inside it. Land and houses do not.

Jharkhand adds a complication no other state has in quite the same form. Large parts of the state's land are held under the Chotanagpur Tenancy Act and the Santhal Parganas Tenancy Act, which restrict the transfer of tribal land. For those holdings, inheritance is recorded at the anchal according to the recorded tenancy and custom, and no court certificate substitutes for it.

The rule of thumb: for a pension file, a PF claim or a land transfer, work the anchal. For a bank refusing to release a large deposit or a demat account, expect to be sent to the District Judge.

Who can and cannot apply?

Any surviving heir under the personal law governing the family can apply. Under the Hindu Succession Act 1956 that means the spouse, sons, daughters and mother as Class I heirs. Muslim, Christian and Parsi families in Jharkhand are governed by their own succession law, and tribal families are additionally governed by recorded custom under the tenancy Acts, which the anchal office applies from the record rather than from a general rule. A minor heir acts through a natural guardian.

You cannot apply if you are not an heir under the law or custom governing that family. A cousin, a neighbour, a bataidar cultivating the land, a business partner or a creditor of the deceased is not eligible, however genuine their interest, a creditor's remedy is a civil suit, not the anchal.

An applicant who cannot show that the deceased ordinarily resided in that anchal, or that the land lies within it, is not eligible at that office and must file where jurisdiction lies. A person seeking authority to collect large bank deposits or securities is not eligible for that purpose through the revenue route at all and must petition the District Judge.

Jharkhand applies no income limit, no caste criterion and no separate domicile test to heirship itself. Residence and the location of the land decide only which anchal hears the file. The local resident certificate JharSewa issues has its own separate criteria and is a supporting document here, not the heirship document.

How to get a legal heir record in Jharkhand

  1. Register the death and collect the death certificate. Apply through JharSewa at jharsewa.jharkhand.gov.in, at a Pragya Kendra, or at the registrar of the place where the death occurred. Take five or six copies, every later office keeps one.
  2. Swear the heir affidavit. Draft it on stamp paper naming every surviving heir with age and relationship, get it notarised, and collect written no-objection from any heir not applying jointly. Do this before approaching the bank or the anchal, because both will ask for it.
  3. Try the affidavit route first. Present the death certificate, the affidavit and a ration card or Aadhaar showing the family together to the employer, pension branch or bank. A large share of Jharkhand claims close here without a revenue case at all.
  4. Identify the existing land record. Where land is involved, pull up the deceased's jamabandi on jharbhoomi.jharkhand.gov.in so you are filing against the right khata and plot. Filing a mutation case against the wrong entry is the commonest cause of rejection.
  5. File the inheritance mutation at the anchal. Apply to the Circle Officer with the death certificate, the affidavit, identity and residence proof and the existing jamabandi details. The Revenue, Registration and Land Reforms Department runs online land mutation on JharBhoomi, and a Pragya Kendra operator can file for you if you cannot.
  6. Pay only the listed charge and keep the receipt. Mutation and rent-receipt charges are printed at the counter or shown on the portal at the payment step. Nothing beyond that is a government fee.
  7. Let the objection window run. The Circle Officer verifies the family through the halka karmchari and the local body, hears any objection filed against the case, and then passes the mutation order.
  8. Download the corrected jamabandi and the online rent receipt. Once the record and the lagan receipt stand in the heirs' names, the transfer is complete, and that record is your heirship proof for every later purpose.

How do I check my application status?

Log in to jharsewa.jharkhand.gov.in with the credentials used to file and open the status view with the application number generated at submission; for a mutation case, track it on jharbhoomi.jharkhand.gov.in against the case number. If a Pragya Kendra operator filed for you, the login sits with the operator, so insist on the printed acknowledgement with the application number before you leave the counter — that number is the only handle you have on the file.

For the portal itself, the State Designated Agency is JAP-IT, Ground Floor, Engineers Hostel No. 2, near Golchakkar, Dhurwa, Ranchi 834004, on 0651-2401581 and 0651-2401040, or at support.edistrict@jharkhandmail.gov.in.

For a stalled revenue file, escalate inside the revenue hierarchy, from the Circle Officer to the Sub-Divisional Officer, then to the Deputy Commissioner, who heads revenue administration in the district. The Revenue, Registration and Land Reforms Department is at Project Bhawan, Dhurwa, Ranchi 834004, on 0651-2400767 and 0651-2400768. Carry the case number, the fee receipt and a copy of the affidavit; every escalation asks for all three.

How do I get a succession certificate from the District Court?

  1. Engage a lawyer and file a petition before the District Judge of the district where the deceased ordinarily resided or where the assets are held, setting out the death, the relationship, the complete list of heirs and a schedule of the debts and securities claimed.
  2. Attach the proof. The death certificate, the heir affidavit and proof of relationship, plus documentary evidence of every asset. The bank passbook, the fixed deposit receipt, the demat statement or the share certificate.
  3. Pay the ad valorem court fee, calculated on the value of the assets listed under the court-fee schedule applicable in Jharkhand. Ask your counsel or the court's copying agency for the exact figure for your value slab before filing; it is the largest single cost in the whole process.
  4. Wait out the citation. The court publishes a public notice inviting objections. If nobody objects within the period allowed, the District Judge grants the certificate; if an objection is filed, the matter is heard on evidence.
  5. Obtain several certified copies at once. Banks and depositories each retain a copy, and returning repeatedly to the copying agency adds weeks.

Does a legal heir record expire?

No. A mutation order and a succession certificate both record a fact that does not change with time, and neither carries a renewal date or a validity period. What changes is the family. A birth, a death or a court decree after the order was passed can force a fresh application, because no institution will act on a list of heirs it can see is out of date.

Why do Jharkhand heirship files get rejected?

An incomplete list of heirs is the leading cause. Leaving out a married daughter, a son working outside the state or a second wife invites an objection at the anchal and unravels everything built on the affidavit. Name every heir, including those waiving their share.

Next comes filing against the wrong land record. An old jamabandi still standing in a grandfather's name means two generations of mutation must be done before the current one can be. After that, mismatched spellings between the Aadhaar, the ration card and the jamabandi; a death certificate registered in the wrong jurisdiction; a missing no-objection from an heir who is not applying; and, on tribal holdings, an application that ignores the restrictions the Chotanagpur Tenancy Act or the Santhal Parganas Tenancy Act place on that land.

What should this cost me?

The genuine government cost of the anchal route in Jharkhand is small: the stamp paper and notarisation for the affidavit, and the mutation and rent-receipt charges printed at the anchal counter or shown on JharBhoomi at the payment step. JharSewa services are applied for free by a citizen directly; a Pragya Kendra operator charges the notified counter fee on top.

Pay at the counter or on the portal, and take the receipt every time. Agents outside anchal offices in Jharkhand routinely quote thousands of rupees for a "legal heir certificate" and present it as a government charge. There is no such certificate and there is no such charge. The only large legitimate cost in this process is the ad valorem court fee on a succession certificate petition, and that is paid into court, not to a middleman.

Documents required

Death certificate of the deceased
Issued by the registrar of the municipality, nagar panchayat or gram panchayat where the death was registered. JharSewa lists "Issue of Death Certificate" as one of its e-District services, so it can be applied for online or through a Pragya Kendra.
Identity proof of the applicant heir
Aadhaar card, voter card, PAN card, driving licence or passport.
Residence proof tying the deceased to the anchal
JharSewa issues a Local Resident Certificate, which is the standard proof of residence in Jharkhand. A ration card, electricity bill, or the land record entry showing the deceased's holding in that anchal also serves.
Affidavit listing every surviving heir
Sworn on stamp paper and notarised, naming each heir with age and relationship to the deceased, and declaring that no heir has been omitted. This is the document banks, pension branches and employers in Jharkhand most often work from.
Proof of relationship for each heir
Ration card showing the family together, Aadhaar, school records, or the marriage certificate for a widow or widower. JharSewa also issues marriage registration certificates.
Existing jamabandi / land record detailsoptional
Required where the purpose is inheritance mutation. The Revenue, Registration and Land Reforms Department runs online land mutation and online lagan payment on jharbhoomi.jharkhand.gov.in, and the existing record has to be identified before a mutation case can be filed.
No-objection from heirs who are not applyingoptional
Needed when one heir files for the whole family. Its absence is the commonest reason a Jharkhand mutation case is objected to.
Service or pension records of the deceasedoptional
Needed where the claim is against an employer, a pension branch or a provident fund office rather than against the land record.

Frequently asked questions

Is there a legal heir certificate on the JharSewa portal?

No — JharSewa, the Jharkhand e-District portal at jharsewa.jharkhand.gov.in, does not list a legal heir or succession certificate. Its published certificate services are birth, caste, death, income, local resident, income and asset certificate for EWS, and marriage registration, alongside the old age, disability and widow pension schemes. Heirship in Jharkhand is handled by the anchal (circle) office of the Revenue, Registration and Land Reforms Department, not by JharSewa.

How do I move a deceased person's land into the heirs' names in Jharkhand?

Through mutation at the anchal office, which the Revenue, Registration and Land Reforms Department has taken online on the JharBhoomi portal at jharbhoomi.jharkhand.gov.in. The department lists digitised revenue and registry records, online land mutation and online lagan payment among its services. The corrected jamabandi and the rent receipt in the heirs' names are the practical proof the transfer is complete.

What does it cost?

The government charge is small — a notarised affidavit on stamp paper, and whatever the anchal office's mutation and rent-receipt charges are, paid at the counter or online against a receipt. Applying yourself on JharSewa or JharBhoomi avoids a Pragya Kendra operator's counter charge. Agents outside anchal offices routinely quote several thousand rupees and call it a government fee; it is not. Ask for the printed fee and the receipt.

Do I need a succession certificate as well?

You need one only when a bank, depository or company refuses to release the deceased's deposits, shares or securities on the affidavit and land record alone. A succession certificate is a judicial order under Sections 370 to 390 of the Indian Succession Act 1925, granted by the District Judge, carrying an ad valorem court fee on the value of the assets listed. For a family pension, provident fund claim or land mutation, the anchal route is enough and far cheaper.

Does a succession certificate transfer land in Jharkhand?

No — a succession certificate covers debts and securities, not immovable property. Land and houses in Jharkhand pass to the heirs by mutation in the revenue record at the anchal office, and where the title itself is disputed, by a civil suit for declaration or partition. Jharkhand adds a further layer: land held by Scheduled Tribe and Scheduled Caste families is governed by the Chotanagpur Tenancy Act and the Santhal Parganas Tenancy Act, which restrict transfer and make the anchal route the only workable one.

Who can apply for heirship in Jharkhand?

Any surviving heir under the personal law governing the family — spouse, sons, daughters and mother are Class I heirs under the Hindu Succession Act 1956, with Muslim, Christian and Parsi families governed by their own succession law, and tribal families in Jharkhand additionally governed by recorded custom under the tenancy Acts. A cousin, tenant, neighbour or creditor is not eligible, however real their interest in the estate.

Can I apply from outside Jharkhand?

Yes, JharSewa and JharBhoomi are open from anywhere, but jurisdiction is fixed by where the deceased ordinarily resided or where the land lies. A family whose relative died in another state must obtain the death certificate from the registrar of that place first, because death registration follows the place of death, not the place of residence.

Whom do I contact if the file stalls?

For the e-District portal itself, the State Designated Agency is JAP-IT at Engineers Hostel No. 2, Dhurwa, Ranchi 834004, reachable on 0651-2401581 and 0651-2401040 or at support.edistrict@jharkhandmail.gov.in. For a stalled revenue file, escalate from the Circle Officer to the Sub-Divisional Officer and then to the Deputy Commissioner of the district; the Revenue, Registration and Land Reforms Department itself sits at Project Bhawan, Dhurwa, Ranchi 834004.
